HomeMy WebLinkAboutResolution No. 6237 (Vacate Public Service Easements)RESOLUTION NO. 6237 RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS WHEREAS, it appears that the easements hereinafter described are unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California; 2. That the City Council. of the City of San Rafael, California, hereby declares its intention to close, vacate and abandon the ease - abandon ments hereinafter described; 3. That TO.e,,day, the 16.tb day of February, 1982 at 8:00 p.m,,, in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easements; -4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easements proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred (300) feet apart but at least three (3) notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. The said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easements proposed to be closed, abandoned and vacated are described on Exhibit A which is attached hereto and incor- porated herein by reference; 6. That a map or plan showing said easements proposed to be closed, abandoned and vacated is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. NO. 9-290-31, HASKELL NORMAN, OWNER (1931 OR 288) Beginning at a point on the northeasterly line of parcel two as described in deed from Marin Canalways and Development Company to Marin Development Company. Recorded March 23, 1956 in book 1016 of Official Records at gage 24 Marin County Records, said point bearing south 38 32' 42" east 119.48 feet from the most northerly corner of said parcel (1016 O. R. 24): Thence north 530 02' 06" 100.00 feet: Thence south 380 32' 42" west 216.40 feet: Thence north 380 46' 00" east 341.91 feet: Thence south 430 14' 14" east 100.98 feet to a point which lies on the westerly boundary of that certain property conveyed in deed to Equitable Development Company, a limited partnership, recorded December 18, 1957, in book 1160 of official records at page 382 of Marin County records. Thence along said westerly line south 380 46' 00" east 448.61 feet to the southwest corner of said parcel (book 1160, page 382). Thence along a curve to the right whose center lies north 460 49' 21" east having a radius of 1263.00 feet through a central angle of 400 37' 57" a distance of 102.12 feet.
