HomeMy WebLinkAboutResolution No. 6241 (MOU North San Rafael Study)RESOLUTION NO. 6241 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with the County of Marin - Memorandum of Understanding for the North San Rafael Study - a copy of which is hereby attached and by this reference made a part hereof. LEONCINI, City Clerk MEMORANDUM OF UNDERSTANDING This is a Memorandum of Understanding between the COUNTY OF MARIN (here- inafter "County") and the CITY OF SAN RAFAEL (hereinafter "City") pertaining to a joint County -City planning study of the North San Rafael area. RECITALS 1. The draft 1981 Marin Countywide Plan states that "the Silveira Ranch - St. Vincent's area has potential for a planned community with a mixture of office, industrial and residential uses. Efforts should be made to prevent this area from being developed into single-family residential subdivision, which would violate the Plan's objectives for energy conservation and moderate - income housing. Because of its historic and geographic isolation, it may be workable to develop it as a self-sufficient, energy -demonstration community. Development should be oriented in density and design toward a possible transit corridor along the Northwestern Pacific right-of-way. The staffs of San Rafael, Novato, and County Planning Department should give a high priority to a cooperative study of this important corridor". 2. Specific Objective #5 of the 1981/82 San Rafael Planning Department budget is "to initiate and complete a planning study of the North San Rafael area, in conjunction with the County of Marin and LAFCo, in order to establish City planning and annexation policies for this major potential growth area within the City's sphere of influence". 3. The Marin County Planning Department applied to the San Francisco Foundation for a Buck Fund grant for a Marin Countywide Plan Implementation and Maintenance program. The San Francisco Foundation approved a grant in the amount of $76,400 to support the economic development and energy elements of the County Plan update. The amount of $48,800 is available for the economic component which pertains to the Silveira Ranch -St. Vincent's area of North San Rafael. 4. The County and City desire to coordinate all preparation, evaluation and adoption procedures pertaining to the joint planning study -to insure, to the greatest possible degree, that the study receives comprehensive consideration by both the County and the City and will ultimately result in adoption by both the County and the City of uniform planning policies for the study area. AGREEMENT 1. Area of Study. The area to be studied includes the lands known as Silveira Ranch (Assessors Parcel #155-010-17, 27, 57, 58 & 59) and St. Vincents (Assessors Parcel #155-010-44, 53 & 54) with particular attention to the Northwestern Pacific Railroad and US Highway 101 corridors between the Marin Civic Center and the ridge south of Pacheco Valle and Hamilton Air Force Base. It is necessary to include lands known as the Daphne property (Assessors Parcel #164-270-03), located in the northwest corner of the Highway 101 and Lucas Valley Road interchange in the study because of this property's importance to the ultimate improvement of that interchange. 2. Scope of Study. The scope of the study shall be as contained in Attachment 1 entitled North San Rafael Study Work Program. That work program will, in turn, be incorporated into a Request for Proposal to consultants and the scope of work in the consultant contract awarded. 3. Consultation with Property Owners. Prior- to commencing any consultant work on the project, representatives of the County and City Planning Departments shall meet with the owners and/or representatives of the properties listed in 1 above. This consultation is required to insure that affected property owners are aware of this study and have early opportunity to com- municate their interests and concerns to County and City representatives. 4. Coordination with City of Novato. The County and City agree to coordinate with the City of Novato by providing information on findings and recommendations of the study, and by using in the study findings and recoim endation from relevant planning work of the City of Novato, particularly that affecting lands immediately north of the study area along Highway 101. 5. Use of Study Findings in Project Review. The County and City agree to use the findings and recommendations of the study in reviewing and acting on development applications for projects adjacent to or near the study area, to the extent possible within time constraints on these projects. 6. Preparation of Study. The study will be prepared by a consultant under contract to the County Planning Department. The consultant will be chosen through a Request for Proposal (RFP) procedure as follows: a. Scope of work in the RFP shall conform to Attachment 1; b. RFP shall be sent to a list of several consultants approved by both County and City Planning Departments;and c. County and City Planning Departments shall agree on selection of consultant. The consultant contract will be executed and administered by the County Planning Department. Monthly reports shall be made by the County to the City on to date status of consultant work and charges. 7. Review of Study. County and City Planning Departments shall jointly review all work of consultant. The consultant work is to be organized in such a way that periodic benchmarks exist to ascertain that the study is on schedule and accomplishing the tasks outlined in the work program. County and City Planning Commissions shall be involved in the review process as recommended by the respective Planning Departments. Likewise, the Board of Supervisors and City Council will review the study as recommended by the respective Planning Departments. 8. Adoption of Study. Both the County and the City seek to adopt policies consistent with the study for inclusion in the Countywide Plan and San Rafael General Plan, respectively. City policies will be the basis for prezoning the study area. In the event that areas of policy difference between the County and City arise, both agencies will strive to modify the policy plan so that it is mutually acceptable. Nothing in this Agreement is to be construed as precluding independent County and City decision making. This Agreement is intended to set forth that both County and City commit to good faith efforts to adopt complementary planning policies for the study area which consists of unincorporated lands within the San Rafael sphere of influence. LEONCINI,'City Clerk ATTACHMENT 1 North San Rafael Study: Work Program Objective: To develop a policy plan for the development of the unincorporated lands north of the Marin Civic Center within the San Rafael Sphere of Influence. These lands are known as the Silveira Ranch and St. Vincents. The plan will be prepared in joint consultation with the City of San Rafael and the County of Marin, and be suitable for adoption by both jurisdictions. The plan will include policies and design guidelines for housing, offices, commercial and/or industrial uses, transportation facilities, services, public improvements, energy supply, and environmental protection. Contract management will be by Marin County Planning Department. The consultant shall possess, or have available, expertise in the areas of general, transportation and environmental planning; economic development; fiscal analysis; and site design. Subcontracts or separate contracts may be appropriate. Time Period: Task 1: Coordinating Committee and Mapping Description: Consultant, after conferring with San Rafael and County Planning sta s, will establish a coordinating committee of appropriate staff persons to provide information for the study. Staff of all local, regional, state and federal agencies with review authority over the site area should be included. Consultant will prepare map(s) of the study area, including data on property lines, topography, existing utilities, transportation lines, streets, easements, and areas subject to tidal action. Map(s) shall be presented to coordinating committee to verify accuracy. Product: Reproducible map(s) Due Date: Task 2: Collect and Analyze Data; Prepare Preliminary Environmental Assessment Description: Consultant will collect, analyze and report on all pertinent in ormation affecting the development of the site, including: - Economic potential for various types of uses on the site, including residential, office, commercial, industrial, transportation, and market analysis, in a range of reasonable alternative mixtures and densities. - Local planning policies affecting the development of the site, in- cluding land use designations, housing policies, environmental controls, transportation and other programmed improvements, energy standards. - Policies of regional, state, and federal agencies affecting the development of the site, including Bay Conservation and Development Commission, State Fish and Game, U.S. Fish and Wildlife, U.S. Army Corps of Engineers, State Lands Commission, etc. -1- - Physical constraints and opportunities for development of the site, including geologic, seismic, hydrological, environmental, and how they might be mitigated. - Transportation constraints and opportunities for development of the site; including present facilities, potential future facilities, availability of funding for improvements, and how these constraints might be mitigated. Particular attention must be given the Highway 101 and Northwestern Pacific Railroad rights-of-way. - Fiscal constraints on the development of the site, including the ability of the City, County and special districts to provide needed services (e.g., present sewer hook-up ban in Las Gallinas Valley), and how these constraints might be overcome. - Social factors affecting the development of the site, including regional, county and local needs for housing, jobs, and private and public services of various types and how these factors could be addressed through development. - Description of development proposals already filed or pending in and near the site, and their effects upon development of the site. - Design characteristics that should affect the development of the site, including appearance and view corridors from Route 101 and nearby employment centers and residential areas. Product: Published report, for review by coordinating committee and the County and City. This will constitute the mid-term report required by the San Francisco Foundation, due June 1, 1982 Due Date: Task 3: Prepare Alternative Development Policies Description: At the direction of the County and City Planning Departments, consultant will prepare a ini nimum of three alternative sets of development policies that are consistent with the findings produced in Task 2. Each alternative will include general guidelines for: - Mixes of uses, including residential, commercial, office, industrial. - Housing sizes, types and densities. - Non-residential land use intensities. - Transportation improvements and programs. - Service and utility improvements. - Design guidelines. - Energy conservation and use criteria. - Environmental protection standards. IWM Each alternative will be analyzed at a general level for economic feasibility, public costs, and level of consistency with the findings produced in Task 2. Product: Published report for review by coordinating committee and selection of preferred alternative by County and City. Due Date: Task 4: Prepare Policy Plan Description: Consultant will prepare a policy plan for the alternative se ec a as a result of Task 3. The plan will include policies pertaining to: - Location of housing, business, industrial, open space, recreational facilities, public buildings, private institutional buildings, waste disposal facilities. - Design guidelines for such buildings and facilities, including the designation of areas where building will be prohibited or subject to special controls because of safety or environmental constraints and including energy conservation and use standards. - The location and extent of existing or proposed streets and other transportation facilities, including timely recommendations. - Standards for mix, density/intensity and timing of land uses. - Provisions for utilities including water supply, sewage disposal, storm water drainage and the disposal of solid waste. - Provisions for public services including police, fire, public works and park and recreation. - Standards for the conservation and protection of natural resources, including wetlands, vegetation, soils, surface waters, and fish and wildlife. Such other measures that may be necessary to insure the implementation of policies determined through Tasks 2 and 3. Product: Draft report for review by coordinating committee and County and City. Due Date: Task 5: Environmental Review Description: Consultant will prepare environmental documentation on the policy plan prepared in Task 4. Product: Draft report, for review in conjunction with the policy plan by the coordinating committee and the County and City Due Date: (Note: same as Task 4) - 3 - Task 6: Prepare Final Policy Plan and Environmental Document Description: Consultant will revise reports prepared in Tasks 4 and 5, in accordance with comments from the coordinating committee and County and City, and compile a single document including policy plan and environmental review. Product: Published final report for adoption by County and City. Final report due to San Francisco Foundation January 1, 1983. Due Date: NOTES: The consultant will be responsible for preparing camera ready text and maps. The Marin County Planning Department will be responsible for report reproduction. The County and City will be responsible for conducting their own noticing and hearing procedures. The consultant will attend a reasonable number of meetings and public hearings, which can be limited in the contract. Adjustments in the time deadlines can be made if public controversy and/or lack of response from involved agencies makes timely completion infeasible. No expenditures over the amount specified in the contract or contracts will be paid to the consultant or consultants without express prior written authorization by the County of Marin after consultation with the City of San Rafael. 103 B/15 - 4 -
