HomeMy WebLinkAboutResolution No. 6244 (Deny Appeal California Avenue)RESOLUTION NO. 6244 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL UPHOLDING THE PLANNING COMMISSION APPROVAL OF ED81-67 AND DENYING THE APPEAL WHEREAS, on November 24, 1981, the San Rafael Planning Commission approved a design review application (ED81-67) for two single family residences on two existing legal lots at the end of California Avenue; and WHEREAS, ED81-67 was appealed by the owners of the adjacent residence to the north on the following grounds: 1. The required slope and width of the existing portion of the access drive (also serving the appellant's residence) is unacceptable; 2. The proposed two story design of the residence closest to the appellant's house would block views; and Plan; and 3. The two lots are inconsistent with the Neighborhood WHEREAS, the City Council on February 1, 1982, held a duly noticed public hearing on the matter and determined that City staff had adequately responded to the grounds of the appeal (staff report dated January 27, 1982); and WHEREAS, the City Council determined that a modified condition C regarding the driveway width was in order to reduce the appellant concerns over grading and retaining walls. NOW, THEREFORE, IT IS RESOLVED that the City Council of the City of San Rafael uphold the Planning Commission approval of ED81-67 and deny the appeal with the following find- ings of fact: 1. As modified by the conditions of approval, the project is consistent with Environmental Design Ordinance. The project has been sited and designed according to the criteria for approval of design review applications called out in 14.11.05 of that ordinance. '�--47� N A L y - i - RESOLUTION NO. 6 2. As modified by the conditions of approval, the project is consistent with the development standards called out in the Neighborhood 13/14 Plan in that the structures have been sited to protect views as much as possible while maintaining privacy for downslope properties, and building materials and landscaping have been used to reduce visual impacts.
