HomeMy WebLinkAboutResolution No. 6254 (Amend Reso 5917 re Francisco Blvd East)RESOLUTION NO. 6254 RESOLUTION AMENDING RESOLUTION OF INTENTION NO. 5917 Francisco Boulevard East Assessment District The City Council of the City of San Rafael resolves: Resolution of Intention No. 5917,adopted by the City Council on the 2nd day of June, 1980, is hereby amended as follows: 1. The following paragraph is hereby deleted: "The amount of any surplus remaining in the im- provement fund after completion of the improvement and payment of all claims shall be transferred to the general fund if the surplus does not exceed the lesser of one thousand dollars ($1,000) or five percent (5%) of the total amount expended from the fund. Otherwise the entire surplus shall be applied as a credit on the assessment as provided in Section 10427.1 of the Streets and Highways Code." And the following paragraph is substituted therefor: "The amount of any surplus remaining in the im- provement fund after completion of the improvement and payment of all claims shall be used, in such amounts as the legislative body may determine, for one or more of the purposes set forth in Section 10427 of the Streets and Highways Code." 2. The following paragraph is hereby deleted: "Serial bonds representing unpaid assessments, and bearing interest at a rate not to exceed ten percent (10%) per annum, will be issued in the manner provided by the Improvement Bond Act of 1915 (Division 10, Streets and Highways Code), and the last installment of the bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date." and the following paragraph is substituted therefor: "Serial bonds representing unpaid assessments, and bearing interest at a rate not to exceed twelve percent (12%) per annum, will be issued in the manner provided by the Improvement Bond Act of 1915 (Division 10, Streets and Highways Code), and the last installment of the bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date." 3. The following paragraph is hereby added: "It is the finding of this Council that,as the result of the construction of the improvements,disparity between the level of the sidewalk and the adjoining private property will exist in certain areas. This Council finds that it is in the public interest and more economical to do the work necessary on private property to eliminate such dis- parity rather than to adjust the work on public property. It is the intention of this Council to perform such work on private property subject to the obtaining of written consent of the owner of the affected property in accordance with the provisions of Section 10100.1 of the Streets & Highways Code of the State of California. The actual cost of such work shall be added to the assessment of the lot on which the work is done." 1 RESOLUTION NO. 6254 I, JEANNE M.
