RESOLUTION DECLARING SURPLUS IN IMPROVEMENT FU14D
SMITH RANCH ASSESSMENT DISTRICT NO. 1
The City Council of the City of San Rafael resolves:
On October 4, 1976, the City Council of the City of San
Rafael, Marin County, California, adopted its Resolution of Intention
No. 5194 for improvements in Smith Ranch Assessment District No. 1,
City of San Rafael, Marin County, California, which Resolution of
Intention was later amended.
Said Resolution of Intention, as amended, provided that
any surplus in the Improvement Fund for said assessment, after comple-
tion of the improvement and payment of all claims from the Improvement
Fund, would be applied as a credit on the assessments, in accordance
with Section 10427.1 of the Streets and Highways Code of the State
of California.
Said improvements have been completed and all claims upon
the Improvement Fund have been paid.
1. That a balance of $259,095.00 remains in the Improvement
Fund for Smith Ranch Assessment District No. 1, and that said amount
is surplus, as set forth in the Engineer's Final Schedule of Costs
attached hereto as Exhibit A, and by reference incorporated herein.
2. That the amount of $259,095.00 shall be applied as a
credit upon the assessments in Smith Ranch Assessment District No.l,
in the manner provided in Sectin 10427.1 of the Streets and Highways
Code.
3. The City Clerk is directed to provide a certified copy
of this resolution to the City Treasurer for his use in making the
credit to each assessment.

I, JEANNE M. LEONCINI, Clerk of the City of San
Rafael, California, hereby certify that the foregoing resolution
was duly and regularly introduced and adopted at a regular meeting
of the Council of said City held on the 1st day of March, 1982,
by the following vote, to wit:

There is on file in the office of the Public Works Director
of the City of San Rafael a detailed recapitulation
of all of the costs incurred in the project, together with
a detailed summary of the total funding, including the
proceeds of the sale of bonds, together with interest
earned thereon to date.
