HomeMy WebLinkAboutResolution No. 6272 (Destruction of Communications Recordings)RESOLUTION NO. 6272 A RESOLUTION OF THE CITY OF SAN RAFAEL AUTHORIZING THE DESTRUCTION OF COMMUNICATIONS RECORDINGS AS PRESCRIBED BY CALIFORNIA GOVERNMENT CODE SECTION 34090.6 WHEREAS, the City of San Rafael Police Department routinely tape records telephone and radio communications; and WHEREAS, existing law provides that these tape record- ings can be destroyed by erasure after 100 days if no litigation is pending that involves a particular tape recording; and WHEREAS, the Chief of Police or his designate will maintain a register of all tape recordings involved in litigation until they have been resolved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that the Chief of Police is directed to destroy by erasure tape recordings after the 100 day period prescribed by law; and BE IT FURTHER RESOLVED that the City Attorney of the City of San Rafael shall give written consent in accordance with current California Government Code Section 34090.6. I, JEANNE M.
