HomeMy WebLinkAboutResolution No. 6274 (Safety Assistance Services Agreement)RESOLUTION NO. 6274 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with Safety Assistance Services a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk kD SAFETY ASSISTANCE AGREEMENT This is an Agreement, entered into on the lst day of January 1982 between the CITY OF SAN RAFAEL, hereinafter called THE CITY, and R.L. KAUTZ & CO., hereinafter called THE SERVICE AGENT. 1. Under terms of this Service Agreement, THE SERVICE AGENT agrees to provide the following assistance to THE CITY. A. Provide THE CITY with a quarterly Graph Analysis & Loss Narrative Report together with a recapitulation summary of this experience which also contains recommendations for implementing improved control measures. B. Initiate and help maintain supportive assistance in helping THE CITY meet its legal obligations under California General Industry Safety Orders, Section 3203: "Accident Prevention Program (a) Every employer shall inaugurate and maintain an accident prevention program which shall include, but not be limited to, the following: 1. A training program designed to instruct employees in general safe work practices and specific instructions with respect to hazards unique to the employee's job requirements. 2. Scheduled periodic (internal inspections to identify and correct unsafe conditions and work practices that may be found." (4 visits per year) (1) Shoot, edit, script, narrate and maintain a general safe lifting slide tape for THE CITY as reinforcement to the general orientation process. a) Make available, at no additional cost, the use of our Loss Control Film Library. (2) Develop and print specific safe practice instructions for potentially hazardous jobs, tailored to THE CITY's needs. (3) Maintain and make available documentation pads suitable for recording GISO Section 3203 activities.' (4) Develop, print and maintain a supply of internal safety in- spection checklists for various types of operations. -2- (5) When and as necessary, initiate group supervisory safety training seminars on specific, agreed -to problem areas. For example, assistance in the organization and implementation of an effective Safety Committee system. (2 per contract year) (6) Provide assistance in the development of safety and health procedures, when requested; and conduct noise level surveys if needed. (7) Provide loss control consultation and research on a need be basis. 2. THE SERVICE AGENT will, in connection with these matters, make recommendations to THE CITY which are consistent with applicable federal and state safety and health regulations. Specific recom- mendations will apply only to those conditions or situations actually observed, however; and such findings would not purport to list all possible hazards nor imply that, if other problems exist, they have been adequately controlled. 3. Representatives of THE SERVICE AGENT shall not be considered as employees of THE CITY; or be intitled to participate in any manage- ment matters (other than by way of advising); or have any authority to cause or direct THE CITY to abide by their recommendations. 4. Engagement of THE SERVICE AGENT, as outlined, shall be effective January 1, 1982. This Agreement may be cancelled or modified by either party giving to the other, in writing, notice of intention sixty (60) days prior to any subsequent anniversary date. 5. For services rendered under this Agreement, THE CITY shall pay to THE SERVICE AGENT the sum of $4950 per year, payable in two equal installments by or on April 15, 1982 and October 15, 1982. . cjv""t," Attest: CITY OF SAN RAFAEL eanne M. Any and all materials produced under the provisions of this agreement become the sole property of the City of San Rafael. 2. In the event that any of the services agreed to and described in the body of this contract are not provided, a corresponding pro -rated reduction in fee will be made ADDENDUM TO AGREEMENT BETWEEN CITY OF SAN RAFAEL AND R.L.
