RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DIRECTING STAFF TO FILE A NOTICE OF MERGER ON CERTAIN
REAL PROPERTY AT 91 & 93 MARINITA AVENUE (COUNTY ASSESSOR'S
PARCEL NUMBERS 14-022-16 AND 14-022-48)
WHEREAS, on March 3, 1982, the owner of the subject
property was sent by registered mail a Notice of Intention to
Record a Notice of Merger on the above -noted property; and
WHEREAS, this Notice of Intent identified a City Council
meeting date of April 19, 1982, in which this item would be
scheduled and reviewed by the City Council; and
WHEREAS, the City Council has determined that the above
noted property is subject to merger under Section 15.10.010 of
the City of San Rafael Municipal Code because of the following
reasons:
a. The subject property consists of two contiguous
parcels in common ownership and at least one of them does not
conform to the standards for minimum parcel size of 5,000 square
feet;
b. One of these parcels is not developed with a building
for which a permit has been issued by the City; and
WHEREAS, on June 24, 1980, the Planning Commission
reviewed a use permit application for development of a single
family dwelling on parcel 14-022-16 and found that development of
this 3,100 square foot lot would adversely impact parking and
traffic because of the inadequate lot frontage (32 feet).
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City
Council identifies a lot merger on the subject property and directs
staff to file a Notice of Merger legally merging County Assessor's
parcel numbers 14-022-16 and 14-022-48 in accordance with Section
15.10.020 of the San Rafael Subdivision Ordinance.

and regularly introduced and adopted at a regular meeting of the
Council of said City on Monday, the 19 day of April, 1982,
