A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of the
City of San Rafael a contract, lease or agreement with
McKeon Construction Company, for extension of time limits for
project processing pursuant to Govt. Code Sec. 65957 - "Meadow
Oaks" development application,
a copy of which is hereby attached and by this reference made a part hereof.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the City Council of said City held on
Monday the fifth
following vote, to wit:

GOVERNMENT CODE SECTION 65957

WITNESSETH:
WHEREAS, McKeon Construction Company, (applicant herein) has submitted
application to the City of San Rafael (City herein) for rezoning from "U" to P --D
for a 117 unit combined townhouse and single family residential development in
Terra Linda; and
WHEREAS, pursuant to Government Code Section 65950, the City "shall approve
or disapprove such project within one year from the date on which an application
requesting approval of such project has been received and accepted as complete by
such agency"; and
WHEREAS, pursuant to Government Code Section 65957, the time limit refer-
enced in Section 65950 "may be extended for a period not to exceed ninety days upon
consent of the public agency and the applicant"; and
WHEREAS, both parties herein desire the maximum time available for pro-
cessing of the zone change; and
WHEREAS, in order to guarantee that the ninety -day time limit extension
is granted automatically if, at the end of February 3, 1981, all permit approval or
disapproval has not been rendered by the City;
NOW, THEREFORE, BOTH PARTIES AGREE that if, at the end of February 3, 1981,
all permit approval or disapproval has not been rendered by the City for the rezoning,
the time limit shall automatically be extended ninety days, commencing February 4,
1981.
