HomeMy WebLinkAboutResolution No. 6148RESOLUTION NO. 6148 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CERTIFYING THE NEGATIVE DECLARATION FOR THE QUAIL HILL EXPANSION PROJECT WHEREAS, on September 23, 1980, the San Rafael Planning Commission considered a staff prepared initial study for the Quail Hill Expansion Project and determined that a focus Environmental Impact Report was required; and WHEREAS, on September 30, 1980, Joseph L. Lemon, legal representative of Quail Hill, Inc. appealed to the City Council the focus Environmental Impact Report determination made by the San Rafael Planning Commission; and WHEREAS, on May 4, 1981 and May 18, 1981,the San Rafael City Council at duly noticed public hearings heard testimony regarding said appeal and on May 18, 1981 appointed a subcommittee of the City Council to meet with the appellant and the City Manager; and WHEREAS, on July 6, 1981,the City Council reviewed and considered a report from the City Manager which outlined the means whereby Quail Hill, Inc. would agree to perform necessary mitigation measures and directed staff to prepare a revised initial study for the project; and WHEREAS, the revised initial study and a draft Negative Declaration were prepared by July 20, 1981, and duly noticed consistent with Section 15083(d) of the State Guidelines for Implementation of the California Environmental Quality Act; and WHEREAS, on August 3, 1981, the City Council considered said revised initial study and draft Negative Declaration together with comments received during the public review process; NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council makes the following findings: 1. While the project has engendered some controversy, the controversy does not amount to "serious public controversy" as evidenced by the lack of response to the over one hundred notices of the revised initial study and draft Negative Declaration mailed to adjacent property owners, homeowner/neighborhood RESOLUTION NO. 6148 associations and other interested parties. 2. That the San Rafael City Council certifies that the Negative Declaration has been prepared in compliance with the California Environmental Quality Act, applicable guidelines, and that it has reviewed and considered the information contained therein and found that no substantial adverse impacts will occur as a result of the Quail Hill Expansion Project because of the numerous substantial mitigation requirements detailed in the initial study dated July 20, 1981. I, JEANNE M.
