RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL EXTENDING TIME FOR
THE COMPLETION OF ROADWAY IMPROVEMENTS
ON REDWOOD DRIVE, SAN RAFAEL, CALIFORNIA
Upon application of the Developer therefore, and due cause
being shown this City Council,
IT IS HEREBY RESOLVED that the time within which the construc-
tion of the improvement work provided for in that certain Agreement
dated June 19, 1978 between the CITY OF SAN RAFAEL and PACIFIC SOUTH-
WEST CONFERENCE OF THE EVANGELICAL COVENANT CHURCH OF AMERICA, as
Developer, shall be completed, be and it is hereby again extended to
and including the 31st day of December, 1981;
BE IT FURTHER RESOLVED that this extension shall not become
effective unless and until said Developer files with the City Clerk
the written consent of the Surety Company upon said Developer's Faithful
Performance and Labor and Materials Bonds to said continuance and waiver
of statute of limitations for the period of said extension, or files
with said clerk a Performance Bond in the amount of $12,000 and a Labor
and Materials Bond in the amount of $6,000 in lieu of the previously
posted surety.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 4th day of May, 1981, by the following vote,
to wit:
AYES: COUNCILMEMBERS: Breiner, Jensen, Miskimen & Mayor Mulryan
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS Nixon
