RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL EXTENDING TIME FOR THE COM-
PLETION OF IMPROVEMENT WORK IN THE WEISSENSEE/
MIDDAGH LAND DIVISION, SAN RAFAEL, CALIFORNIA
Upon application of the developer therefore, and due
cause being shown this City Council,
IT IS HEREBY RESOLVED that the time within which the
construction of the improvement work in the Weissensee/Middagh
Land Division (S78-5) as provided for in that certain Agreement
between the CITY OF SAN RAFAEL and CONRAD WEISSENSEE and ROBERT A.
MIDDAGH, as developer, shall be completed, be and it is hereby
again extended to and including the lst day of October, 1981; this
extension shall not become effective unless and until said developer
files with the City Clerk on or before June 15, 1981 a letter of
credit renewal or the written consent of the Surety Company upon
said Developer's Faithful Performance Bond to said continuance and
waiver of statute of limitations for the period of said extension;
BE IT FURTHER RESOLVED that no further extensions shall
be granted by the City Council subsequent to October 1, 1981, and
that all remaining improvement work must be completed by October 1,
1981 or the City shall invoke developer's contract security to
complete said improvements.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the lst day of June, 1981, by the
following vote, to wit:
