HomeMy WebLinkAboutResolution No. 6184RESOLUTION NO. 6184 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with Royston, Hanamoto, Beck & Abey for Landscape Architectural Services for Albert Park Renovation Project a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk ORIGINAL L9�IA AGREEMENT FOR LANDSCAPE ARCHITECTURAL SERVICES THIS AGREEMENT, made and entered into this 21st day of September , 1981, by and between the CITY Of SAN RAFAEL, a municipal corporation of the State of California, herein- after called "City", and ROYSTON, HANAMOTO, ALLEY & ABEY, hereinafter called "Landscape Architect", witnesseth: —TPYT— AT n City desires to employ the services of said Landscape Architect for preparation for the development of the area shown on the approved Master Plan as passive use areas (i.e., picnic, play areas, open turf meadow, teen multi -use slab and additional parking at the San Rafael Community Center building). General City engages Landscape Architect to furnish the services hereinafter mentioned, at and for the compensation herein stipulated, and Landscape Architect accepts said engagement upon said terms. 2. York Tasks of Landscape Architect Landscape Architect shall: I. Design Development: a. Prepare base map at a scale of 1" = 20' from the Master Plan survey and additional survey informa- tion for Cook's Plumbing Building site. b. Prepare preliminary plan alternatives showing proposed uses. C. Review with staff and determine optimum alternative. d. finalize Design Development Plan, including sculptured element location proposed by the "Inter -Arts of Marin" grant. e. Prepare preliminary cost estimate based on 1982 costs. f. Render plans with color. g. Review with staff. h. Presentation to Parks and Recreation Commission. i. Presentation to City Council. NO II. Working Drawings and Technical Specifications a. Prepare layout and detail reference plan. b. Prepare grading and drainage plan. C. Prepare construction details (including consultation with Inter -Arts of Marin on sculptural element). d. Prepare planting plan and details. e. Prepare irrigation plan and details. f. Prepare electrical plan and details. g. Prepare renovation plans and details for stadium restrooms. h. Prepare bidding documents and technical specifications for above work. i. Prepare pre-bid cost estimate. j. Review with staff. k. Presentation to Parks and Recreation Commission. 1. Presentation to City Council for final approval. m. Assist City during bidding process by answering questions, issuing addenda and reviewing and making recommendations on the bid results. n. Provide construction observation. 3. Data and Services to be Provided by City The following data and services will be furnished without cost to Landscape Architect by City: a. Additional survey information for Cook's Plumbing building site. b. Records and maps available in City's files or any other such information to aid Landscape Architect in his studies for successful planning and designing of the project. C. City to print and send documents out to bid. 4. Compensation a. Total compensation for all landscape architectural services, including consultants for design develop- -2- ment, working drawings and technical specifications, and construction observation shall be at a not -to - exceed amount of $27,142.00 at the hourly rates listed on "Exhibit A". b. The following work task breakdown and related fees are given as a guide to phases of services provided: Phase I Design Development, $3,886; Phase II Working Drawings and Technical Specifications, $17,784; Phase III Construction Observation, $5,472. 5. Payments by City City shall pay the Landscape Architect in accordance with the attached schedule of rates (Exhibit A). The maximum fee for the services rendered will be $27,142. In event that the project area now planned is added to or if there is change in program after the planning work has begun, the maximum fee for the services shall be adjusted upwards as mutually agreed upon between City and the Land- scape Architect. 6. Schedule of Landscape Architect's Services Landscape Architect's services shall begin immediately upon receipt of the executed Agreement and Work Task Authorization, and shall be completed within ninety (90) working days. 7. Termination City may at its sole discretion terminate this Agreement by written notice delivered personally or mailed to Landscape Architect. In the event of such termination, Landscape Architect shall forthwith discontinue further services. Landscape Architect shall be paid all sums due to him at time of termination and the reasonable value of services then due and rendered up to the time of termination. In the event of such termination, Landscape Architect shall turn over to City one copy of any and all studies, sketches, drawings, computations, whether completed or in the course of preparation as the permanent property of City. -3- 8. Non -Assignment This Agreement shall not be assignable by either City or Landscape Architect. CHARGES FOR SERVICES Charges for Basic and Extra Services shall be based on hourly rates not to exceed the following schedule: Principals' Time: Associates' Time: Assistants' Time: Technical Staff : Clerical & Office: Consultants' Time: $45.00 to $65.00 30.00 to 38.00 25.00 to 30.00 18.00 to 25.00 16.00 25.00 to 50.00 All of these rates are current for six months from the date of Agreement for Professional Services, but may be increased periodically. Expenses: Automobile Travel: $ .20 per mile Airfare & Car Rental: At Cost Overnight Travel: $ 50.00 Per Diem Blueprints & Reproductions: At Cost Reimbursable expenses are in addition to the Compensation for Basic and Additional Services and include actual expenditures made by the Landscape Architect, his employees or his professional consultants in the interest of the project. II. OWNERSHIP OF DOCUMENTS Drawings and Specifications, as instruments of service, are and shall remain the property of the Landscape Architect and Planners whether or not the project for which they are made is executed. III. PAYMENTS Statements for the work shall be rendered monthly in proportion to the amount of work completed.
