HomeMy WebLinkAboutResolution No. 6190RESOLUTION NO. 6190 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING A VARIANCE FOR THE GIA WESTON NEON SIGN FOR THE FRENCH QUARTER WHEREAS, the San Rafael Sign Ordinance specifies that plans submitted sumultaneously with plans for any development signs are subject to environmental design review (14.11.02); and WHEREAS, on June 13, 1978, the Planning Commission con- ditionally approved a design review application for the French Quarter at 610 Third and 901-909 Irwin Street which included a sign program; and WHEREAS, on June 18, 1981, application for a revised sign program with a variance to allow a neon sign was made to legit- imatize several signs installed which were inconsistent with the original program; and WHEREAS, on July 28, 1981, the Planning Commission re- viewed the above application and granted conditional approval based upon a staff recommendation; and WHEREAS, the Planning Commission on July 28, 1981, determined that certain signs, namely the heart shaped signs and window signs, were inconsistent with the overall design of the project; and WHEREAS, on September 21, 1981, the San Rafael City Council held a duly noticed public hearing on the appeal of the Planning Commission decision reviewing staff and Commission information and receiving testimony. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael grants a sign variance to allow the "Gia Weston" neon window sign for a period of one year or until September 21, 1982, at which time, unless extended, the sign shall be removed and the originally approved multi -paned window reinstated. BE IT FURTHER RESOLVED that the San Rafael City Council approved said variance with the following findings of fact as required under Section 14.12.070 of the San Rafael Municipal Code: 0 Ri I I N A -- L - 1 - qo RESOLUTION NO. 61r A. There are exceptional or extraordinary circumstances applying to the building that do not apply to other buildings in the area. 1. The French Quarter project consisted of rehab- ilitation of several dilapidated residential buildings to allow for new commercial and residential uses. The project in this way represented an adaptive reuse of existing historical buildings as opposed to complete redevelopment of the property. Because of the residential configuration and the historical exterior that must be preserved under the City landmark designation for the property there are special signing needs that apply to the building. 2. The building occupied by "Gia Weston" has a narrow frontage on Irwin Street, a major roadway, and the side of the building faces Third Street, a major roadway. The situation of the subject building in relation to these one-way streets further constitutes special circumstance. B. The granting of a variance is necessary for the enjoyment of substantial property rights of the petitioner. The granting of variance for a one year period will allow sufficient time for the establishment of the current use and amortization of the costs of the neon sign which has already been installed. C. The granting of the variance will not adversely affect adjacent or vicinity properties, or the health and/or safety of the public. I, JEANNE M.
