HomeMy WebLinkAboutResolution No. 6169RESOLUTION NO. 6169 RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS IN EAST SAN RAFAEL (GRANGE PROPERTY) WHEREAS, it appears that the easements hereinafter described are unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASE- MENTS VACATION LAW of the State of California; 2. That the City Council of the City of San Rafael, Calif- ornia, hereby declares its intention to close, vacate and abandon the easements hereinafter described; 3. That Monday, the 5th day of October, 1981 at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easements; 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easements proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred (300) feet apart but at least three (3) notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. The said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easements proposed to be closed, abandoned and vacated are described on Exhibit A which is attached hereto and in- corporated herein by reference; 6. That a map or plan showing said easements proposed to be closed, abandoned and vacated is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. LEONCIN EXHIBIT "A" DESCRIPTION OF' EASEMENTS TO BE ABANDONED IN EAST SAN RAFAEL (GRANGE PROPERTY) 30' X 30' SLOPE & DRAINAGE EASEMENT A parcel of land, 30.00 feet square, lying northeasterly of and contiguous of the southwesterly line of that certain 4.00 acre tract of land described as Parcel Two in the deed to Marin Development Co., recorded March 23, 1956 in Volume 1016, page 24, Offical Records of Marin County, the northwesterly line of said 30.00 foot square parcel being parallel with and distant 148.71 feet, southeasterly, at right angles, from the northwesterly line of. said Parcel Two, (OR 1016, p. 24). 100' X 210' DRAINAGE EASEMENT An easement for drainage purposes, 100 feet in width, lying 50 feet on each side of the following described center line: Beginning at a point on the Southwesterly line of Parcel Two as described in the Deed from Marin Canalways and Development Company to Marin Development Company, recorded March 23, 1956 in Book 1016 of Official Records at page 24, P4arin County Records, said point bears South 380 32' 42" East 163.71 feet from the most Westerly corner thereof; thence leaving said Southwesterly line and running North 530 02' 06" East 210.08 feet to a point on the Northeasterly line of said parcel (1016 OR 24), said point bears South 380 32' 42" East 169.50 feet from the most Northerly corner of said parcel, extending and shortening the side lines so as to terminate at the Southwesterly and Northeasterly boundary of said parcel. 30' X 210' UTILITY & AMISS EASEMENT' 30 foot wide utility and access easement affecting the southeasterly portion of Parcel One as described in the deed from Western Title Guaranty Company to Francisco Company recorded May 3, 1967 in Book 2126 at page 87, Marin County Records, and as shown upon that certain Assess- ment Diagram entitled "Assessment Diagram Francisco Boulevard Assessment District, City of San Rafael, County of Marin, California" recorded February 23, 1965 in Book 1913 at page 21, Marin Countv Records. 10' X 30' SLOPE & DRAINAGE EASEMENT A strip of land, 10.00 feet wide, the center line of which is described as follows: Beginning for reference at the most southwesterly corner of that certain parcel of land described in the deed to Michael J. Scotto, et al, recorded July 19, 1956 in Volume 1043, page 597, Official Records of Marin County; thence along the southerly line of said parcel from a tangent that bears S. 72 26' 27" E., along a curve to the left with a radius of 973 feet through an angle of 30 04' 44", an arc distance of 52.29 feet to the true point of commencement, thence N. 140 28' 49" E_, 30.00 feet.
