HomeMy WebLinkAboutResolution No. 6170AMENDED TITLE RESOLUTION NO. 6170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING THE OLD BAY WAY AND POINT SAN PEDRO ROAD ANNEXATION PURSUANT TO THE MUNICIPAL ORGANIZATION ACT OF 1977 WHEREAS, The City Council of the City of San Rafael by Resolution No. 6071 adopted March 23, 1981, initiated preliminary proceedings for the Old Bay Way and Point San Pedro Road Annexa- tion and applied to the Local Agency Formation Commission of Marin County for determinations thereon; and WHEREAS, LAFCO by Resolution No. 81-19 adopted July 30, 1981, made determinations in approving said annexation. NOW, THEREFORE, BE IT RESOLVED: Section 1. This annexation has been proposed pursuant to, and is in compliance with, provisions of the Municipal Organ- ization Act of 1977: a. The territory to be annexed has been designated as "Old Bay Way and Point San Pedro Road Annexation," and its bound- aries are as set forth in Exhibit A, and attached legal description. b. The territory is uninhabited. C. The territory is being annexed to eliminate an island of unincorporated land within City boundaries. d. The resolution of application was accompanied by written consent signed by all owners of land within the territory to be annexed. Section 2. The Local Agency Formation Commission of Marin County has made the following determinations in approving the said annexation: a. The boundaries of the territory proposed to be annexed shall be those set forth in Exhibit A, and said territory shall be designated as the Old Bay Way and Point San Pedro Road Annexation. b. Said territory is found to be uninhabited. C. The City of San Rafael as the appropriate lead agency has conducted an initial study incorporating concerns of said Commission and has issued a Negative Declaration. The City of San Rafael is the appropriate conducting authority to direct complete annexation proceedings and is authorized to proceed without notice, hearing, or election pursuant to Govern- ment Code Section 35151, as there is written consent of all owners of land within said territory. Section 3. The City Council of the City of San Rafael hereby approves and states its intention to proceed with the Old Bay Way and Point San Pedro Road Annexation. Section 4. The Clerk of the City Council of the City of San Rafael is hereby authorized and directed to file a certified copy of this resolution with the Executive Officer of the Local Agency Formation Commission of the County of Marin. LEONCINI, City Clerk - 2 - OLD BAY WAY AND POINT SAN PEDRO ROAD ANNEXATION To the City of San Rafael in the County of Marin No. 24-80 DESCRIPTION: 2/29/80 JD BEGINNING at the reference survey monument found at the intersection of the center line of Bay Way with the Southerly line of Point San Pedro Road as shown on the Map of Seastrand as recorded in Book 17 of Maps at Page 72 of Marin County Records; thence along said Southerly line North 81031'27" West 250.04 feet to the most Northwesterly point of Lot 35 of said Map of Seastrand, which point is also a point on the existing limits line of the City of San Rafael and is the true Point of Beginning of this description. BEGINNING at said true Point of Beginning; thence North 1°09' West 300 feet, more or less, to a point on the Westerly line of the Lands of Chatham as recorded in Book 1833 at Page 35 of Marin County Records, said point being also a point on the existing limits line of the City of San Rafael; thence along said limits line Easterly and Southerly to a point on the Northerly line of Point San Pedro Road; thence continuing along said limits line and said Northerly line Easterly to a point on said line; thence crossing said Point San Pedro Road to a point on the Southerly line thereof; thence Westerly along said limits line and said Southerly line of Point San Pedro Road to the intersection of said Southerly line with the Easterly line of Old Bay Way; thence continuing along said limits line Southerly along the Easterly line of Old Bay Way to a point; thence Westerly and along the Southerly line of Lot 36 of the Map of Seastrand and Northerly along the Westerly lines of Lots 36 and 35 of the Map of Seastrand to the Point of Beginning.
