A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL INITIATING PROCEEDINGS FOR
NUNES OPEN SPACE PARCEL "E" ANNEXATION PURSUANT
TO THE MUNICIPAL ORGANIZATION ACT OF 1977
WHEREAS, The City Council of the City of San Rafael by
Resolution No. 6118 adopted June 15, 1981, initiated preliminary
proceedings for the Nunes Open Space Parcel "E" Annexation and
applied to the Local Agency Formation Commission of Marin County
for determinations thereon; and
WHEREAS, LAFCO by Resolution No. 81-28 adopted August 13,
1981, made determinations in approving said annexation.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. This annexation has been proposed pursuant
to, and is in compliance with, provisions of the Municipal Organ-
ization Act of 1977:
a. The territory to be annexed has been designated as
"Nunes Open Space Parcel "E" Annexation," and its boundaries are
as set forth in Exhibit A, and attached legal description.
b. The territory is uninhabited.
C. The territory is being annexed to eliminate the
obligation of the City to pay property taxes on subject parcel.
d. The resolution of application was accompanied by
a plan for providing services.
Section 2. The Local Agency Formation Commission of
Marin County has made the following determinations in approving the
said annexation:
a. The boundaries of the territory proposed to be
annexed shall be those set forth in Exhibit A, and said territory
shall be designated as the Nunes Open Space Parcel "E" Annexation.
b. Said territory is found to be uninhabited.
C. The project is Categorically Exempt pursuant to pro-
visions of the California Environmental Quality Act and the Com-
mission's Environmental Guidelines.

d. The City of San Rafael is the appropriate conducting
authority to direct complete annexation proceedings and is authorized
to proceed.
Section 3. The City Council of the City of San Rafael
hereby states its intention to proceed with the Nunes Open Space
Parcel "E" Annexation and sets November 2, 1981, at 8:00 PM, in
the San Rafael City Council Chambers as the date, time and place
for a public hearing on said annexation.
Section 4. Any owner of land within the territory may
file a written protest against the annexation with the City council
at the San Rafael City Hall, in the form specified by Government
Code Sections 35205 and 35225, at any time prior to the conclusion
of the November 2, 1981, hearing or continuation thereof.
Section 5. The Clerk of the City Council of the City
of San Rafael is hereby authorized and directed to file a certified
copy of this resolution with the Executive Officer of the Local
Agency Formation Commission of the County of Marin.

certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
on Monday , the 21st day of September, 1981, by the following vote,

ANNEXATION
to the City of San Rafael
in the County of Marin
DESCRIPTION
All that real property situate in the County of
as conveyed jointly by and to the County Service
Marin County Open Space District and to the City
recorded January 11, 1980, in Book 3665 at Page
and more particularly described as follows:

Beginning at a point on the southwesterly boundary line of the Rancho Sari
Pedro Santa Margarita y Las Gallinas, said point being on the existing
Corporate Limits line of the City of San Rafael at the southwesterly terminus
of that certain course described as having a bearing of South 36°00' West
by Ordinance No. 706 (Nunes Ranch Annexation) adopted May 2, 1960, by the
City Council of the City of San Rafael and running thence along said Rancho
line North 45°34'21" West,1923.96 feet; thence leaving said Rancho line and
along the common boundary between the Lands of C.S.A. No. 23 and the Lands of
Luiz the following courses; North 15048'09" East, 312.40 feet; North 27`34'09"
East, 532.76 feet; North 53°11'09" East,289.33 feet; North 44°10'04" East,
118.39 feet; and North 32°02'04" East, 145.79 feet to the common point of
the Lands of C.S.A. 23 and the Lands of Luiz and the Lands of Melone; thence
along the common boundary between the Lands of C.S.A. 23 and the Lands of
flelone the following courses; South 30041156" East, 617.62 feet; South
70°03'47" East, 192.36 feet; and North 82023'06",1848.18 feet to the existing
Limits line of the City of San Rafael at the Westerly terminus of that certain
course described as having a bearing of North 73032'30" West by aforementioned
Ordinance No. 706; thence along said existing Limits line South 37°57'34"
West,2726.60 feet to the Point of Beginning.
Containing 80.933 acres, more or less.
