HomeMy WebLinkAboutResolution No. 6192RESOLUTION NO. 6192 RESOLUTION ORDERING CLOSING, ABANDONING AND VACATING VARIOUS EASEMENTS WHEREAS, the City Council of the City of San Rafael on the 8th day of September , 19 81 , adopted Resolution No. 6169 entitled, RESOLUTION OF INTENTION TO VACATE VARIOUS EASEMENTS; and WHEREAS, said Resolution was posted as required by law; and WHEREAS, the Department of Public Works of the City of San Rafael, California, conspicuously posted notices of easement vacation as required by law; and WHEREAS, a hearing was had this day as required by law and said Resolution No. 616 , at which hearing -the Council of the City of San Rafael heard evidence offered by persons interested; and WHEREAS, it appears from all of the evidence submitted that the following described easements are unnecessary for present or prospective public use; NOW, THEREFORE, IT IS HEREBY RESOLVED as follows: 1. That the following described easements are unnecessary for present or prospective public use; 2. That the following described easements are hereby ordered. closed, abandoned and vacated; 3. That the easements closed, abandoned and vacated are. described on Exhibit "A" which is attached hereto and incorporated herein by reference. I, JEANNE P1. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing Resolution was duly and regularly intro- duced and adopted at a regular meeting of the Council of the City of San Rafael held on the 5th day of October , 19 81 , by -the following vote, to wit: AYES: COUNCILTMEMBERS: Breiner, Jensen, Miskimen, Nixon & Mayor Mulryan NOES: COUNCILMEMBERS : None ABSENT: COUNCILMEMBERS: None COPYANNE M. LEONCIN. , City Clerk EXHIBIT "A" DESCRIPTION OF EASEMENTS TO BE ABANDONED IN EAST SAN RAFAEL (GRANGE PROPERTY) 100' X 210' DRAINAGE EASEMENT An easement for drainage purposes, 100 feet in width, lying 50 feet on each side of the following described center line: Beginning at a point on the Southwesterly line of Parcel Two as described in the Deed from Marin Canalways and Development Company to Marin Development Company, recorded March 23, 1956 in Book. 1016 of Official Records at page 24, Marin County Records, said point bears South 380 32' 42" East 163.71 feet from the most Westerly corner thereof; thence leaving said Southwesterly line and running North 530 02' 06" East 2.1.0.08 feet to a point on the Northeasterly line of said parcel (1.01G OR 24), said point bears South 380 32' 42" East 169.50 feet from the most Northerly corner of said parcel, extending and shortening the side lines so as to terminate at the Southwesterly and Northeasterly boundary of said parcel. 10' X 30' SLOPE & DRAINAGE EASEMENT A strip of land, 10.00 feet wide, the center line of which is described as follows: Beginning for reference at the most southwesterly corner of that certain parcel of lard described in the deed to Michael J.
