A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
SAN RAFAEL SCHOOL DISTRICT FOR RENTAL OF ONE PORTABLE CLASSROOM
AT BAHIA VISTA ELEMENTARY SCHOOL TO CONDUCT CHILD CARE PROGRAM.
a copy of which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the City Council of said
City held on Monday the 2nd day of November
19 81, by the following vote, to wit:

LEASE AGREEMENT
RENTAL OF A PORTABLE CLASSROOM
AT
BAHIA VISTA SCHOOL
THIS AGREEMENT made this 2nd day of November 1981,
between the CITY OF SAN RAFAEL, hereinafter referred to as "City" and the
SAN RAFAEL SCHOOL DISTRICT, hereinafter referred to as "District".
RECITALS
WHEREAS, City and District are mutually agreeable to an agreement
allowing City to use one (1) Portable Classroom of approximately 900 square
feet, located at BAHIA VISTA ELEMENTARY SCHOOL, 125 Bahia Way, San Rafael,
for the 1981-82 school year, starting on September 1, 1981 and ending on
June 30, 1982, for the sum of TWO IiUNDRED DOLLARS ($200.00) per month.
WITNESSETH
FOR AND IN consideration of mutual promises, covenants and conditions
hereinafter contained, the parties hereto agree as follows:
1) City is hereby granted by District the right to use one (1) Portable
Classroom at BAHIA VISTA ELEMENTARY SCHOOL for the purpose of providing
a Child Care Program.
2) District will furnish utilities and maintenance.
3) City agrees to pay a monthly rental charge of $200.00 per month,
payable on the first day of each calendar month.
4) City shall indemnify and hold District harmless from any liability
for personal injury or property damage arising out of the use of
District facilities by City pursuant to this Agreement.
5) This Agreement may be amended or terminated by the mutual consent
of the parties hereto and may be cancelled by either party upon
thirty (30) days' notice.
