A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
BOY SCOUTS OF AMERICA REGARDING RECYCLING BIN AT THE TERRA
LINDA RECREATION CENTER
a copy of which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the City Council of said
City held on Monday the 2nd day of November
19 81, by the following vote, to wit:

A G R E E M E N T
THIS AGREEMENT, entered into this 2nd clay of November
1981, by and between the CITY OF SAN PAFAEL, hereinafter referred to as
"City", and the BOY SCOUTS OF AMERICA TROOP 76, hereinafter referred to
as "Scouts".
WITNESSETH
WHEREAS, City is the owner of certain property known as the
Terra Linda Recreation Center, North Parking Lot, at 670 Del Ganado
Road; and,
WHEREAS, Scouts are desirous of using a portion of this site
to store a recycling bin to store newspapers.
NOW, THEREFORE, BE IT HEREBY AGREED AS FOLLOWS:
1. City shall permit Scouts to place recycling bin in the
Northwest Corner of said parking lot.
3. City will grant Scouts permission to place recycling bin
on site for a three-month trial period.
3. After three months, City will evaluate the proposed use
for the site. If there are no problems, use will be
granted on a permanent basis subject to proper termination.
4. Scouts agree to place screening and landscaping around
bin.
5. Scouts agree to do daily pickups around the area and
to keep area clean and orderly.
6. Scouts agree to pay for any damage to parking lot and
general area caused by recycling operation.
7. Scouts agree to indemnify and save City, its officers,
agents and employees, harmless from any liability for
injuries to persons or damage to property caused or
resulting in any manner from City's performance in pro-
viding a location.
8. This Agreement may be terminated upon 90 days' written
notice by either party.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the date and year first above-mentioned.
