RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN RAFAEL AUTHORIZING THE
SIGNING OF AN AGREEMENT AND ACCEPTING
GRANT OF RIGHT-OF-WAY - WEST FRANCISCO
BOULEVARD EXTENSION PROJECT
WHEREAS, the public interest, convenience, necessity and
welfare require that the City of San Rafael enter into an agreement
for acquisition of right of way for use for the benefit of the public
of said City in conjunction with the West Francisco Boulevard Exten-
sion Project;
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City Council
of the City of San Rafael, California, does hereby authorize the Mayor
and City Clerk to execute, on behalf of the City of San Rafael, an
agreement with Homer C. and Lillian Rickards for grant of property for
street right of way purposes in exchange for certain considerations as
specified in said Agreement, a copy of which is attached hereto and
incorporated herein by this reference;
BE IT FURTHER RESOLVED that said City Council does hereby accept
that certain Grant Deed from Homer C. and Lillian Rickards and the real
property described therein, all as more particularly described and set
forth in said Deed, a copy of which is attached hereto and incorporated
herein by reference, and the Clerk of said City is hereby directed to cause
said deed to be duly recorded in the Office of the County Recorder of the
County of Marin, State of California, forthwith upon the adoption of
this resoltuion.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the Council
of said City held on the 3rd day of March, 1980, by the following vote,
to wit:

AGREEMENT
THIS AGREEMENT, made on the 6 TM day of M A.RC H 1980
by and between THE CITY OF SAN RAFAEL party of the first part, herein-
after called the CITY, and HOMER C. AND LILLIAN RICKARD4•part of the
second part, hereinafter called RICKARDS.
WITNESSETH, that the CITY and the RICKARDS, for the considerations here-
inafter named, agree as follows:
1. RICKARDS hereby grant to CITY that certain real property
as described on the Grant Deed (Exhibit "A") attached
hereto and incorporated herein by reference in conjunction
with the San Rafael Redevelopment Agency's West Francisco
Boulevard Extension Project.
2. CITY, as consideration for grant of said property des-
cribed in said Exhibit "A", will cause to have constructed
concrete curb and gutter along RICKARDS' property at 666
Irwin Street and asphalt conform paving into their parking
lot as required for the installation of the curb and gutter
and as shown on Exhibit "B" attached hereto and incorporated
herein by reference.
3. CITY will provide engineering and construction inspection
of the improvements as described in paragraph 2 and as
shown on Exhibit "B" at no expense to the RICKARDS.
4. Standard driveway or driveways will be provided across
the concrete curb and gutter with the exact location to
be determined by the CITY and RICKARDS at a later date.
5. During construction of the aforementioned Project, access
will be provided to the RICKARDS' property at 666 Irwin
Street at all times.

Beginning at a 1" iron pipe, said pipe being -set at the intersection of
the center line of the main N.W.P.R.R. tracks and the easterly right-of-
way line of Irwin Street, as per that map filed for record with the Marin
County Recorder in Book 10, on page 21; thence S8003112"W, 66.817 feet
to the "true point of beginning" continuing:
thence from said true point of beginning; S8003112"W along the easterly
right-of-way of Irwin Street 60 feet; thence on a reversed non -tangent
curve to the left, whose center bears S74082'43.75"E, said curve having
a radius of 58 feet, through an arc of 46 27'47.78" to the northerly
limits of the lands of Homer and Lillian Rickards as described in that
document recorded in Book 1337 on page 252, in the records of the County
Recorder, Marin County; thence along said northerly line N40023'48"W,31
feet + returning to the true point of beginning having an area of
551.3317 Sq. Ft.
