RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL
DENYING A REZONING FROM "U" TO R -1-B-3
FOR PROPERTY AT 25 DeANZA WAY
WHEREAS, the owner of property generally known as 25 DeAnza
Way applied for a rezoning of that property from its existing "U"
(Unclassified) zoning district to an R -1-B-3 (Large Lot Single Family
Residential) zoning district on November 9, 1979; and
WHEREAS, the proposed rezoning could result in substantial
grading and tree loss which would adversely affect the hillside character
of the site; and
WHEREAS, the subject site is a long thin hillside parcel that
stretches behind a number of existing homes; and
WHEREAS, the General Plan designates this site as a Residential
and Open Space Review Area encouraging the preservation of ridge and
hillside areas as backdrops and separators between neighborhoods; and
WHEREAS, the Planning Commission held a public hearing on the
proposed rezoning and denied the request; and
WHEREAS, the owner of the property filed an appeal of the
Planning Commission denial; and
WHEREAS, the City Council held a public hearing on May 19,
1980 to review the appeal;
NOW, THEREFORE, BE IT RESOLVED that the proposed rezoning
could result in significant grading and tree loss which would adversely
affect the hillside character of the site;
BE IT FURTHER RESOLVED that the unusual shape and hillside
character of the site necessitates zoning to a specific development plan
to insure that the development would not adversely affect adjacent
properties;
BE IT FURTHER RESOLVED that the proposal to Rezoning Application
Z79-20 be denied due to the fact that it could cause environmental
damage and adversely affect surrounding development.

regularly introduced and adopted at a regular meeting of the Council of
said City held on the second day of June , 1980, by the
following vote, to wit:
