A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
San Rafael School District and Marin County Office of Education for the use of
Short Elementary School as a Child Care Center.
a copy of which is hereby attached and by this reference made a part
hereof.

certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the City Council of said

SHORT SCHOOL
THIS AGREEMENT, entered into this
24th
day of June , 1980,
by and between the City of San Rafael, hereinafter referred to as "City";
the Marin County Office of Education, hereinafter referred to as "County";
and the San Rafael School District, hereinafter referred to as "District"
W I T N E S S E T H:
WHEREAS, District is the owner of that certain real property known
as the SHORT SCHOOL; and
WHEREAS, said SHORT SCHOOL is not now, and will not be during the
term of this Agreement, needed for school classroom buildings by District;
and
WHEREAS, City and County are desirous of leasing said school for
certain functions provided by the City of San Rafael Recreation Depart -
meet and the Marin County Office of Education; and
WHEREAS, Education Code Sections 39500, et. seq., provides that a
school district may lease school property not needed for classroom use to
another governmental agency.
NOW, THEREFORE, BE IT HEREBY AGREED AS follows:
1. District leases to City and County; and City and County leases
from District, that property known as SHORT SCHOOL (see attachment) for
a period commencing August 1, 1980 through July 30, 1983 for the con-
sideration shown in the schedule below:

Payable in quarterly installments no later than the eighth (8th)
calendar day after the start of the lease; and, at the beginning of each
quarterly period thereafter.
2. It shall be the obligation of City and County to pay costs of
water, electricity, gas, alarms, garbage pick up and minor maintenance.
3. District is responsible for major maintenance of the plant, including
roofs, asphalt surfaces, heating and air conditioning and major plumbing repairs.
4. District shall maintain, in force, the existing fire and extended
coverage insurance on the buildings.

5. It shall be the responsibility of City and County to maintain in
force during the term of this agreement, public liability insurance namini
District as an additional insured. It shall further be the responsibilit,
of City and County to maintain appropriate insurance on the contents of tI
buildings. District shall indemnify and hold City and County harmless frc
any liability for personal injury or property damage arising out of
structural defects or the District's negligence in its maintenance.
6. City and County shall not make structural alterations without fir::
receiving written permission from District.
7. City and County shall not sub -lease or assign the use of any port:
of the leased premises without the written approval of the District
Administration.
8. This Lease may be terminated upon six (6) months notice by the
District to the City and County. This Lease may also be extended for
additional years upon written agreement of all parties.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement
on the day and year first above written.
