HomeMy WebLinkAboutResolution No. 5929RESOLUTION NO. 5929 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING RESOLUTION No. 5714 AND EXHIBIT B & C PERTAINING TO THE COMPENSATION AND WORKING CONDITIONS FOR POLICE DEPARTMENT PERSONNEL BE IT RESOLVED by the City Council of the City of San Rafael as follows: Section 1. Salaries. Effective July 1, 1979, a salary increase of eight percent (8%) shall be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps, and ranges pursuant to Exhibit "A" attached. Effective July 1, 1980, a salary increase of eleven percent (11%) shall t be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps, and ranges pursuant to Exhibit "B" attached. Effective July 1, 1981, a six percent (6%) salary increase shall be paid to all employees covered by this resolution and shall be applied across the board to all classifications, steps, and ranges pursuant to Exhibit "C" attached. Section 2. Salary Designations. The salaries herein established are monthly compensation unless otherwise specified. Section 3. The Administration of the Pay Plan. Salary advancements shall be made on the basis of the salary rates, salary ranges and salary steps set forth opposite each classification in this resolution. Before any person is advanced to the next step, a written statement must be filed by the Department Head with the City Manager recommending such increase. The steps of each salary range shall be applied as follows: The first step is the minimum rate and shall normally be the hiring rate for the class. In cases when it is difficult to secure qualified personnel, or if a person of unusual qualifi- cations is engaged, the City Manager may hire at a higher step. The remaining steps represent the ordinary next salary steps for each year of service, providing the employee is qualified in his work to receive the next step. Anniversary date shall be interpreted as the 1st day of the month for those employees entering the service between the 1st and 15th of the month and on the 1st day of the next month for those entering the service after the 15th of the month. RESOLUTION NO. 5929, p. 2 The semi-monthly pay period shall be the 15th day of each month and the last normal working day of each month. Section 4. Appointments and Salaries. The City Manager in accordance with the Personnel Rules and Regulations may make appointments of prospective employees to a position in a class for which the salary is herein provided and designate the definite salary rate or salary step at which such a person is appointed. The salary so designated is thereby fixed as the salary of such employee for such position; provided, further, that the City Manager may from time to time increase or decrease the salaries of persons so appointed in accordance with provisions of Section 1, provided that the salary so fixed is within the ranges established for that classification. Section 5. Part-time and Temporary Employment. Employees appointed to any of the positions referred to herein and employed or working on a part- time basis shall be paid in proportion to the time worked and described in their appointment. Temporary employees may be appointed by the City Manager when authorized budget funds are available. Section 6. Additional Pay for Police Department. Police Department personnel assigned to the following duty shall receive additional compensa- tion amounting to five percent (5%) of their basic monthly salary: Operation of a solo -motorcycle for more than 50% of his work month. Female employees who are requested to perform the duties of Police Matron shall receive $2.50 per hour in addition to their regular hourly rate of pay for only actual time served in this capacity. Section 7. Holidays. The shift personnel in the Police Department, namely the Police Sergeant, Police Corporal, Police Officer, Communications Dispatcher and Police Cadet, are entitled to straight time compensation for every holiday in each given year which all other City employees received as time off. Said compensation shall be paid twice each year on the first pay period of December and the first pay period of June. Section 8. Overtime. RESOLUTION NO. 5929, D. 3 All safety employees with the exception of De- partment Heads and supervisory personnel, who are required to work in excess of their basic work week during any one week shall be given compensatory time off at the rate of time and one-half, or, upon the recommendation of the Department Head and subject to approval of the City Manager, shall be paid at the rate of time and one-half of their established hourly rate, based on their regular monthly salary. Upon accrual of five (5) days or forty (40) hours of overtime, members of the Police Department shall be paid at the rate of time and one-half of their established hourly rate. Notification by the Officer in Charge directing that compensatory time be taken, or by the employees requesting compensatory time off, on any specific date must be submitted not less than five (5) days in advance for the mutual agreement of both parties. In addition, those members who are required in the course and scope of their official employment to appear in Court other than during their regular tour of duty or shift of hours, shall receive a minimum of three (3) hours pay at the rate of time and one-half of their established hourly rate. In the event that an employee resigns or is terminated, he shall be entitled to compensation for his accumulated overtime. For the purpose of computing overtime, the work shall be defined as beginning at 12:01 A.M. Sunday morning and ending at 12:00 midnight Saturday. Section 9. Educational Incentive. The educational incentive program now in existence for employees of the Police Department shall continue; provided, however, that, effective July 1, 1979, payment for Post -Intermediate Certificate and for Advanced Certificate shall no longer be solely a percent- age of employee salary, but shall have the following maximum amounts: Intermediate Certificate Advanced Certificate Sergeant $94.00 $135.00 Corporal 86.00 122.00 Officer 81.00 117.00 RESOLUTION NO. 5929, p. 4 To qualify for educational incentive compensation an employee shall have worked no less than one (1) year for the City. As a further condition to such qualification, all sworn personnel shall be required to undertake and maintain all educational programs set forth by law under the Peace Officers Standards and Training Program. Section 10. Sick Leave. Upon termination of employment, by resigna- tion, retirement or death, a police employee who leaves the municipal service in good standing shall receive compensation for all accumulated unused sick leave based upon the rate of three percent (3%) for each year of service, to a maximum of fifty percent (50%). Commencing July 1, 1979 no new employee of the City's Police Department shall be entitled to a payment of unused sick leave. Section 11. Automobile Allowance. Any employee or City official shall be reimbursed at the rate of seventeen cents (17) per mile for use of his private car when traveling on authorized City business. Section 12. Uniform Allowance. Uniformed members of the Police De- partment shall receive a uniform allowance in the amount of $150.00 at the completion of each six months of service ending June 30 and December 31; a proration at the rate of $25.00 per month may be given for a portion of the first and last six months of service upon recommendation of the Department Head and approval of the City Manager. Administrative and Investigative personnel who occasionally wear a uniform shall receive $200.00 annually as a uniform allowance. Section 13. Medical Insurance. Effective July 1, 1981, City agrees to pick up a maximum of fifteen percent (15%) of any increase in premiums in health plan rates, over the premium cost to City for Association employees in year one (1) of this Agreement. Section 14. Retirement Contribution. Effective July 1, 1979, City agrees to payment of employees' contribution to Marin County Retirement System, up to a maximum of four percent (4%) of an employees salary or 50% of the employees retirement contribution rate, whichever is less. RESOLUTION NO. 5929, p. 5 Section 15. Long -Term Disability Insurance. City agrees to cooperate with and permit Police Bargaining Unit to withdraw from City's long-term dis- ability plan to PORAC Plan so long as, and only if, such withdrawal is at no cost to City, either in additional cost of premiums to PORAC, or change in experience rating to City by a reduction in monthly salaries across the board in an amount equal to the monthly increase in the premium rate, to the extent that it exceeds ten percent (10%). Section 16. Dental Insurance. City agrees to pay any increased rate in connection with the Dental Insurance program carried by the California Dental Service, Program III A, as presently being offered by City to employ- ees, from the date of any such increase and for the term of this Agreement. Section 17. Management Personnel. The positions of Chief of Police, Police Captains, Police Lieutenants, and Secretary to the Chief of Police are deemed to be management positions and shall be excluded from the bargaining unit represented by the Association. Section 18. Shift Changes. The parties hereto agree that changes in the days or hours of the regular work schedule of an employee shall entitle such employee to overtime compensation at the rate of time and one-half for any hours worked outside the employee's regular work schedule, unless City shall have given employee seven (7) days notice of such change; provided, however, that no advance notice to employees by City of shift change shall be required and no overtime shall be required to be paid by City when shift changes occur as the result of emergencies, multiple sicknesses, disabilities or injury, or at the specific request of an employee. Section 19. Effective Date. This resolution shall take effect forthwith upon its adoption and the several compensations and allowances herein provided shall be in full force and effect as of and from July 1, 1979 through June 30, 1981.
