A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
Terra Linda Recreation Center - Approval of fee schedule.
a copy of which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the City Council of said
City held on Monday the 18th day of August

HOLD HARMLESS AGREEMEPTf
As an applicant for use of City of San Rafael areas or facilities, I hereby agree to assume all risks for loss, damage,
liability, injury, cost or expense that may arise during or be caused in any way by use or occupancy of an area or facility
of the City of San Rafael.
I further agree that in consideration of being permitted to use said facility, I will save and hold the City of San Rafael
and/or its employees free and harmless from any loss, claim, liabilities, damages, and/or injuries to persons and property
that in any way may be caused by or during applicant's use or occupancy of said areas and/or facilities.
I further agree, if alcoholic beverages are served, that I will provide public liability insurance of an amount not less than
$100,000 with the City named as Additional insured to protect the applicant and the City from any loss, claim, liabilities,
or damages, and/or injuries to persons and property attending the function.

GENERAL POLICY
The Terra Linda Recreation Center operates under the jurisdiction of the City of San Rafael and is intended primarily for
cultural, educatiunal and social programs. Individuals and community groups are permitted and encouraged to use the Center,
which is available on a reservation basis.

1. Fees are for a t%yo-hour minimum.
2. Non-profit resident organizations must use Center for non -fundraising event to be eligible for Group II. If it is a
fundraiser, the classification is Group III.
3. To be considered a Saar Rafael resident, individuals must reside within City limits. For organizations or groups, San
Rafael residency is established by having a San Rafael mailing address, as well as proof that 50,0 of their members live
within the San Rafael City limits.
4. Any governmental tax -supported agency located in Marin which does not fall under Groups I or II, qualifies as Group III.
5. All events for business or ccrrercial use, for profit or gain, qualify as Group IV.
G. $100 refundable cleaning and damage deposit must accompany application.
ADDITIONAL FEES
1. Evening and weekend hours require an additional $5.00 per hour charge which is used to cover administrative costs,
utilities, and a required staff attendant.
APPLICATION PROCEDURES
1. Reservations will be accepted G months in advance. AI.1 fees and insurance forms (and ABC permit when required) are due
10 days prior to the event.
2. Hours of use stated on the application permit must include set-up time as well as clean-up time.
3. Application permits are non -transferable.
4. All applicants must comply with the state alcoholic beverage policy if alcoholic beverages are to be sold.
5. Reservations for the use of the Center by youth groups must be completed by an adult sponsor.
G. At the discretion of the Center Director, security or police officers may be required.
7. The applicant must provide a Certificate of Insurance stating that the event is covered for a minimum of $100,000 public
liability insurance. The City of San Rafael must be named as an additional insured.
S. The applicant whose signature appears on the registration form should arrive at the starting time designated and should
plan to be present until the end of the event. If the applicant cannot be present, he should designate an individual and
place that name on the application.
9. All facilities must be left in the same condition as before the event started. If additional clean-up is required, all
or a portion of the deposit will be retained and the user will be charged for all extra costs required.
SPECIAL ODNSIDI'.RATIONS
1. No smoking is allayed inside the building.
2. No tape, adhesives, nails, screws, staples, tacks, or pins are allowed in/or on walls, woodwork, or windows.
3. Permanent interior furnishings are not to be moved.
4. Neither birdseed nor rice is allayed to be thrown at weddings.
5. Fifty percent of deposit will be retained if event is cancelled ten days or more before the event. If the event is
cancelled less than ten days before an event, all monies paid will be retained.
G. Reservations may be revoked at any time whenever the use of building or facilities may interfere with department program
activities or where there has been a violation of approved regulations.
