RESOLUTION OF APPLICATION TO THE
MARIN LOCAL AGENCY FORMATION COMMISSION
IS MADE FOR AN ANNEXATION
PURSUANT TO THE MUNICIPAL ORGANIZATION ACT
(M.M.W.D. Tank Site Annexation)
WHEREAS, pursuant to the Municipal Organization Act of 1977, commencing
with Section 35000 of the California Government Code, a City Council representing
the City of San Rafael may, by resolution adopted by this legislative body,
initiate proceedings involving annexation to said city; and
WHEREAS, the subject territory is located in the County of Marin.
NOW, THEREFORE, BE IT RESOLVED:
Section 1. Application, which is hereby made to the Marin Local Agency
Formation Commission of the County of Marin, proposes the following:
A. This proposal is made pursuant to, and is in compliance with pro-
visions of the Municipal Organization Act of 1977.
B. Said application requests that proceedings be taken for annexation
of uninhabited territory affecting the City of San Rafael.
C. The boundaries of the affected territory are illustrated on an
attached map, and are described in Exhibit A, an attached legal description.
D. This proposal is submitted for the following reason: to eliminate
island of unincorporated land within City boundaries.
E. Municipal services which shall be required include: Police and
Fire protection, sewer and street maintenance, recreation services.
Section 2. This resolution is submitted and shall be accompanied by a
plan for services prepared by the affected city pursuant to Section 35102 of the
California Government Codes.
Section 3. The Clerk of the City Council of the City of San Rafael
is hereby authorized and directed to file a certified copy of this resolution
with the Executive Officer of the Local Agency Formation Commission of the County
of Marin.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of San Rafael, County of Marin, State of California, held on this 18th
day of August , 1980, by the following vote:

NOES: COUNCILMEMBERS: None

EXHIBIT A
M.M.W.D. TANK SITE ANNEXATION
TO THE CITY OF SAN RAFAEL
Description
Beginning at the most easterly point of the subdivision known as Rafael
Highlands Unit One as recorded in Book 8 of Maps at page 19 of Marin
County Records, said point being the juncture of courses north 340 47'
east, 579.254 feet and the arc concave to the south having a radius of 150
feet, a central angle of 220 16' 42" and a length of. 58.325 feet; thence
north 340 30' west 35.101 feet to the southeasterly corner of the Lands of
Marin Municipal Water District as recorded in Book 700 of Official Records
at page 89, said point being the True Point of Beginning of this description
and also a point on the existing Limits Line of the City of San Rafael.
Thence from said True Point of Begininng clockwise around the periphery of
said Marin Municipal Water District Lot and along said existing Limits Line
the following courses: South 730 03' west, 65 feet; north 160 53' west,
55.35 feet; north 710 46' east, 65.01 feet and south 160 53', 56.88 feet to
the True Point of Beginning.
Containing approximately 3,647 square feet.
