A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
CERTIFYING NEGATIVE DECLARATION FOR AND
AMENDING THE SAN RAFAEL GENERAL PLAN BY ADOPTION
OF THE NEIGHBORHOOD 13/14 NEIGHBORHOOD PLAN; AND
DECLARING THE COUNCIL'S INTENT TO REZONE CERTAIN
PROPERTIES
WHEREAS, the San Rafael City Council, on July 21 and
September 2, 1980, held public hearings to review a proposal
initiated by the City Council on Neighborhoods 13 and 14, in which
it was proposed that said Neighborhoods would be subject to a
comprehensive Neighborhood Plan; and
WHEREAS, the San Rafael Planning Commission held public
hearings and, on June 10, 1980, recommended that the subject pro-
posal be recommended for approval by the San Rafael City Council;
and
WHEREAS, the San Rafael City Council has reviewed the
initial study required by the California Environmental Quality
Act and found it adequate and complete and, further, that no
substantial adverse environmental impacts will occur as a result
of this project; and
WHEREAS, to fully implement said Neighborhood Plan, the
City Council will be obliged to effect certain rezoning of proper-
ties so that said zoning shall be consistent with the adopted
Neighborhood Plan; and
WHEREAS, in order to adopt said Neighborhood Plan, a
General Plan amendment is necessary; and
WHEREAS, after review and consideration of the text of
the Plan itself, Staff material, and comments and remarks by
Neighborhood Plan organizations and property owners and other
interested parties therein, the City Council finds that said
Neighborhood Plan implements the requirements of the San Rafael
City General Plan, specifically Section IV, C.2, by providing
refinement and detail of said General Plan for Neighborhoods 13
and 14; and
WHEREAS, the City Council further finds that said
Neighborhood Plan for Neighborhoods 13 and 14 provides for the
health, safety, and welfare, not only of the residents and land-
owners of said neighborhood, but for the entire community, as

well, by providing sound and justifiable means for the further
development of said neighborhood through provision of guidelines
for development which evaluate land capability by consideration
of neighborhood community features and environmental constraints.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City
certifies that the Negative Declaration for the Neighborhood Plan
has been prepared in compliance with CEQA, State and City Guide-
lines; and that it has reviewed and considered the information
contained therein.
BE IT FURTHER RESOLVED by the San Rafael City Council
that it is in the public interest that the San Rafael General Plan
be amended by adoption of the Neighborhood Plan for Neighborhoods
13 and 14.
BE IT FURTHER RESOLVED that the City Council declares
its intent to set such public hearings as necessary to review
those zoning ordinances and proposed rezonings, including pro-
posed interim rezoning to an Unclassified zoning classification
necessary to implement the purposes of the Neighborhood 13/14
Neighborhood Plan.
BE IT FURTHER RESOLVED that the Neighborhood Plan for
Neighborhoods 13/14 shall not become effective until such time as
the interim rezoning which implements said Plan are in full force
and effect.

certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
on Tuesday the second day of September 1980, by the following
vote, to wit:
