A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
REQUESTING LAFCO AMEND THE SPHERE OF
INFLUENCE BOUNDARY AND WAIVE THE APPROPRIATE
APPLICATION FEE
WHEREAS, the City of San Rafael has prepared a Neighbor-
hood Plan for Neighborhoods 13 and 14; and
WHEREAS, as a result of said Plan, the necessity and
propriety of a Sphere of Influence boundary amendment was
recommended; and
WHEREAS, the City of San Rafael, the City of San Anselmo,
and LAFCO presently each show conflicting and overlapping Sphere
of Influence boundaries; and
WHEREAS, in order to correct such conflict, a proposed
amended Sphere of Influence boundary has been reviewed by the
Staff of the three referenced agencies and has been found to be
reasonable, mutually agreeable, and consistent with the provisions
of Government Code Section 54774; and
WHEREAS, for the purposes of maintaining an emergency
access route to Neighborhood 13 in San Rafael, the San Rafael and
San Anselmo Staffs have agreed, and the San Rafael City Council
so finds that the emergency access route through the Mt. Tamalpais
Cemetery to San Anselmo should be maintained; and
WHEREAS, the San Rafael City Staff has accomplished
much of the work in gaining mutual acceptance of the San Anselmo
City Staff in working out the proposed boundary change, and in so
doing has alleviated much of the task of the LAFCO Staff, and
City of San Rafael now requests a waiver of the application fee
to LAFCO for the referenced boundary change; and
WHEREAS, the San Rafael Planning Commission has con-
ducted public hearings on the Neighborhood 13/14 Neighborhood
Plan and the proposed Sphere of Influence boundary amendment
following appropriate notification.
NOW THEREFORE BE IT RESOLVED that the San Rafael City
Council requests that the Marin LAFCO effect a boundary change
for the Sphere of Influence as outlined in Attachment A.

BE IT FURTHER RESOLVED that the San Rafael City Council
requests that LAFCO waive the application fee for the boundary
change requested herein.

certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a regular meeting of the Council of said City
on Tuesday the second day of September , 1980, by the following
vote, to wit:
