HomeMy WebLinkAboutResolution No. 5991RESOLUTION NO. 5991 RESOLUTION ORDERING JUDICIAL FORECLOSURE PURSUANT TO THE IMPROVEMENT BOND ACT OF 1915 The City Council of the City of San Rafael resolves: On November 4, 1974, the City Council passed its resolution ordering the construction of improvements in East San Rafael Drainage Assessment District No. 2. The improvements were constructed in accordance with the order. To pay the cost of construction, special assessments were levied against the following described parcels of land (along with others) pursuant to the Improvement Bond Act of 1915, and bonds were issued on the security of the assessments, pursuant to the Improvement Bond Act of 1915. These parcels are now delinquent in the payment of one or more installments of principal and interest on the assessments in the following amounts: Assessment No. Amount of Description of Property Delinquency 1 Parcel No. 9-290-26 $ 20,279.96 28A 9-161-37 461.92 The City Council orders a judicial foreclosure against the described property. The firm of Sturgis, Ness, Brunsell & Sperry, a professional corporation, Attorneys at Law, Emeryville, California, is retained to conduct the foreclosure. The legal fee of that firm is to be collected in the foreclosure proceedings. Cost of title reports shall be paid by the City of San Rafael and recovered as costs in the foreclosure proceeding. This resolution is adopted pursuant to Section 8830 of the Streets and Highways Code.
