RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE SIGNING OF LICENSE AGREEMENTS FOR INSTAL-
LATION OF LANDSCAPE IMPROVEMENTS AT THE ENTRANCE OF PEACOCK
DRIVE AT POINT SAN PEDRO ROAD, MARIN BAY IMPROVEMENT
DISTRICT NO. 2
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY
RESOLVES as follows:
The Mayor and City Clerk are authorized to execute, on
behalf of the City of San Rafael, two License Agreements; one
with Birte Lunding and one with Virginia Algeo for installation
of landscape improvements at the entrance of Peacock Drive at
Point San Pedro Road, Marin Bay Improvement District No. 2.
A copy of both License Agreements is attached hereto and incor-
porated herein by this reference.
I, JEANNE 17. LEONCINI, City Clerk of the City of `San
Rafael, California, hereby certify that the foregoing resolution
was duly and regularly introduced and adopted at a regular
meeting of the Council of said City held on the lst day of
December, 1980, by the following vote, to wit:

Mayor Mulryan

LICENSE AGREEMENT
This Agreement made this ST day of
-.C.• 1980, by and between der -gen V. Lunding, hereinafter referred to as
"Licensor", and the City of San Rafael of the County of Marin, State
of California, hereinafter referred to as "Licensee";
WHEREAS, Licensor is the owner or rightful possessor of
certain real property commonly known as Four Peacock Drive, San Rafael,
Marin County, California, more particularly described as follows:
Assessor's Parcel #185-063-01; and
WHEREAS, Licensee desires to obtain permission to perform
certain acts upon Licensor's property,
NOW, THEREFORE, it is agreed as follows:
1. Licensor grants to Licensee a license to shore up exist-
ing trees; build up the soil, plant turf; put in a decorative two rail
fence; add irrigation and perform all acts necessary to complete these
and other landscape maintenance functions.
2. It is further agreed that the Licensor and Licensee shall
mutually indemnify and hold harmless each other, their officers,
agents, employees and contractors from any liability for injuries to
persons or property caused by or resulting from the activities permit-
ted in this License and those necessary to complete the landscape
maintenance functions herein mentioned, except for those injuries to
persons or property caused by or resulting from the negligence or
willful misconduct of either the Licensor or Licensee, their officers,
agents, employees or contractors.
3. This License is personal to the Licensee, its agents,
employees and contractors. It is non -assignable, and any attempt to
assign this License terminates it.
4. This Agreement is terminable at will.

LICENSE AGREEMENt

"Licensor", and the City of San Rafael of the County of Marin, State
of California, hereinafter referred to as "Licensee";
WHEREAS, Licensor is the owner or rightful possessor of

WHEREAS, Licensee desires to obtain permission to perform
certain acts upon Licensor's property,
NOW, THEREFORE, it is agreed as follows:
1. Licensor grants to Licensee a license to shore up exist-
ing trees; build up the soil, plant turf; put in a decorative two rail
fence; add irrigation and perform all acts necessary to complete these
and other landscape maintenance functions.
2. It is further agreed that the Licensee shall indemnify
and hold harmless the City of San Rafael, its officers, agents,
employees and contractors from any liability for injuries to persons
or property cuased by or resulting from the activities permitted in
this License and those necessary to complete the landscape maintenance
fi.inctions herein mentioned, except for those injuries to persons or
property caused by or resulting from the negligence or willful
misconduct of the City, its officers, agents, employees or contractors.
3. This License is personal to the Licensee, its officers,
agents, employees and contractors. It is non -assignable, and any attempt
to assign this License terminates it.
4. This Agreement is terminable at will.
