HomeMy WebLinkAboutResolution No. 6038RESOLUTION NO. 6038 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING THE PEACOCK GAP NEIGHBORHOOD PLAN AND AMENDMENT TO THE SAN RAFAEL GENERAL PLAN AND DECLARING THE CITY'S INTENT TO INITIATE REZONING AND NREZONING OF PROPERTIES CONSISTENT WITH SAID PLAN WHEREAS, in 1974 the City of San Rafael adopted a General Plan which set forth "neighborhood planning" as Basic Policy 9; and WHEREAS, beginning in May, 1979, with the choice of John Roberto and Associates as consultant, the City has worked with the residents, property owners and other interested agencies, groups and individuals while preparing the Peacock Gap Neighborhood Plan; and WHEREAS, there were four meetings held in the neighborhood to consult with and make presentations to the residents, property owners, developers, and other interested parties; and WHEREAS, the San Rafael Planning Commission held public hearings on April 8, 1980; May 6, 1980; and September 3, 1980; and conducted public meetings on May 20, 1980; June 17, 1980; June 23, 1980; July 1, 1980; and July 22, 1980; and WHEREAS, the Planning Commission and City Council have reviewed and con- sidered the content and findings of the Environmental Impact Report prepared for the Peacock Gap Neighborhood Plan and alternatives; and WHEREAS, to adopt the Peacock Gap Neighborhood Plan, a General Pian amend- ment is necessary in order to change the designation of Pt. San Pedro Road between Riviera Drive and the entrance to the Dillingham property from a two-lane local arterial to a four -lane local arterial; and WHEREAS, after review and consideration of the text of the Plan, staff materials, and written and verbal testimony by neighborhood organizations, property owners, and other interested parties, the Planning Commission recommended that said Neighborhood Plan as revised in August, 1980, and further revised per Commission direction on September 3, 1980, implements the requirements of the San Rafael General Plan, specifically Section IV, C2, by providing refinement and detail of said General Plan for the Peacock Gap Neighborhood; and WHEREAS, the Planning Commission further recommended that said Peacock Gap Neighborhood Plan provides for the health, safety, and welfare, not only of the residents and landowners of said neighborhood, but for the entire community, as well, by providing sound and justifiable means for the further development of said neighborhood through the provision of guidelines for development which evaluate land capabilities and housing by consideration of neighborhood community features and environmental constraints and opportunities; and O�JKGONAL 6038' RESOLUTION NO. 6038 WHEREAS, the City Council held public hearings on October 20, 1980, November 24, 1980, and December 1, 1980 and a public meeting on December 15, 1980, and after review and consideration of the text of the Planning staff materials, Planning Commission recommendations, and written and verbal testimony by neighborhood organizations, property owners, and other interested parties, the City Council finds that said Neighborhood Plan as recommended by the Planning Commission on September 3, 1980, and amended by Council motions on December 15, 1980, implements the requirements of the San Rafael General Plan, specifically Section IV, C2, by providing refinement and detail of said General Plan for the Peacock Gap Neighborhood; and WHEREAS, the City Council further finds that said Peacock Gap Neighborhood Plan provides for the health, safety, and welfare, not only of the residents and landowners of said neighborhood, but for the entire community, as well, by providing sound and justifiable means for the further development of said neighborhood through the provision of guidelines for development which evaluate land capabilities and housing needs by consideration of neighborhood and community features and environ- mental constraints and opportunities; and WHEREAS, to fully implement said Neighborhood Plan, the City will be obliged to effect certain rezoning and prezoning of property so that said zoning shall be consistent with the adopted Neighborhood Plan and to enter into development agreements with owners of the major vacant parcels. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council adopts the Peacock Gap Neighborhood Plan and amendment of the San Rafael General Plan. BE IT FURTHER RESOLVED that the City Council joins the Planning Commission in declaring the City's intent to set such public hearings as necessary to rezone and prezone properties within the Peacock Gap neighborhood as necessary to fulfill the purpose and intent of the Peacock Gap Neighborhood Plan.
