A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL EXTENDING TIME FOR COMPLETION OF
IMPROVEMENTS, NORTHGATE EAST DEVELOPMENT, PHASES
2 AND
Upon application of the Developer therefor, and due
cause being shown this City Council:
BE IT RESOLVED that the time within which the construc-
tion of the improvement work provided for in those certain Agree-
ments, more particularly described as follows:
AGREEMENT FOR COMPLETION OF IMPROVEMENT WORK
DESIGNATED "PHASE 2 - FRONTAGE IMPROVEMENTS -
CIVIC CENTER DRIVE (FRONTAGE ROAD) ADJOINING
A.P. NO. 155-200-01 (NORTHGATE EAST PROPERTY)
FOR THE NORTHGATE EAST DEVELOPMENT"; and
AGREEMENT FOR COMPLETION OF IMPROVEMENT WORK
DESIGNATED "PHASE 3 - FRONTAGE IMPROVEMENTS -
CIVIC CENTER DRIVE (FRONTAGE ROAD) AND PORTION
OF LANDSCAPING ADJOINING A.P. NO. 155-200-01
(NORTHGATE EAST PROPERTY) FOR THE NORTHGATE EAST
DEVELOPMENT",
between the City of San Rafael and NORTHGATE EAST, as Developer,
shall be completed, be and it is hereby extended to and includinq
the 3rd day of December, 1979, or until completion and occupancy
of the "Fireman's Plaza" building now under construction at 4040
Civic Center Drive. This extension shall not become effective
unless and until said Developer files with the Director of Public
Works the written consent of the surety company upon said Developer's
Faithful Performance and Labor and Material Bonds to said continuance
and waiver of statute of limitations for the period of said extension.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 2nd day of January, 1979, by
the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor
Berttini
NOES: COUNCILMEN: None
