A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of the
City of San Rafael a contract, lease or agreement with
MARIN SANITARY SERVICE (Sixth Amendment to Agreement)
a copy of which is hereby attached and by this reference made a part hereof.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular
meeting of the City Council of said City held on
Tuesday the second day of January , 19 79 by the
following vote, to wit:

SIXTH AMENDMENT TO AGREEMENT
The parties hereto are the CITY OF SAN RAFAEL, a municipal
corporation organized and existing under and by virtue of the laws
of the State of California, hereinafter referred to as "City" and
MARIN SANITARY SERVICE, a California corporation, hereinafter referred
to as "Company".
W I T N E S S E T H:
WHEREAS, the parties have heretofore entered into a written
agreement dated June 20, 1966 relating to the collection of all refuse
from within the City, and have amended the same pursuant to documents
dated October 6, 1969, June 24, 1971, May 15, 1972, July 1, 1974, and
January 17, 1977; and
WHEREAS, the parties now desire to further amend and modify
said agreement in the respects hereinafter set forth; and
WHEREAS, City has heretofore held a public hearing in the
matter and has determined that said further amendment and modification
is proper and in the best interests of its citizens;
NOW, THEREFORE, it is mutually agreed that the written
agreement between the parties dated June 20, 1966 and the amendments
thereto dated October 6, 1969, June 24, 1971, May 15, 1972, July 1,
1974 and January 17, 1977, shall be and the same are hereby amended
and modified in the following manner:
1. The maximum schedule of rates and services as recited
in section , at page 3 of the agreement dated June 20, 1966 and in
the amendments heretofore mentioned are amended on each effective
date to read as follows: Calendar Year 1979
Single-family Residential Effective January 1, 1979
One 30 -gallon can (One Collection Per Week)
Level areas $4.70 per month
Hill areas $5.45 per month
Two 30 -gallon cans (One Collection Per Week)
Level areas $7.65 per month
Hill areas $8.80 per month
(The aforementioned rates shall apply to cans located
not more than one hundred (100) feet from the collec-
tion vehicle. For any can located more than one hundred
(100) feet, add $.75 per can for each additional fifty
(50) feet or portion thereof.)
Multiple Unit Residential

Per agreement with customer,
but not exceeding $4.70 per
cubic yard.
A 6.45% increase plus a one-
time two-year increase of 2.95%
for a total of 9.4%.

2. The rates and charges provided for herein shall be double
for the collection of materials which have been compacted by mechanical,
electrical, or hydraulic means.
3. The above rates shall be applicable from January 1, 1979
through December 31, 1979, except that the 2.95% dumping charge
remains until December 31, 1980.
4. Other than as specifically amended and modified, the
aforesaid agreement between the parties dated June 20, 1966 and the
aforesaid amendments thereto are hereby ratified and confirmed to be
and continue in full force and effect.
IN WITNESS WHEREOF, the parties hereby have executed this
agreement on the day of January, 1979.
