HomeMy WebLinkAboutResolution No. 5627RESOLUTION NO. 5627 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ACCEPTING DEVELOPMENT RIGHTS FROM THE NEW YORK - CAL. INDUSTRIAL CORP. (PEACOCK GAP HILL) WHEREAS, the State of California, the County of Marin, the Marin County Open Space District and the City of San Rafael entered into a general agreement to preserve open space on the San Pedro peninsula; and, WHEREAS, the culmination of these efforts was the formulation of the China Camp State Park; and, WHEREAS, the properties for China Camp State Park were purchased from the New York - Cal. Industrial Corp.; and, WHEREAS, in the negotiations for this purchase, New York - Cal. Industrial Corp. pledged all development rights above 125 feet elevation on those properties outlined in Exhibit "A"; and, WHEREAS, this development right was duly recorded upon the subdivision map which completed the transfer of land; and, WHEREAS, the City should formally accept these development rights, NOW, THEREFORE BE IT RESOLVED, by the San Rafael City Council that the development rights offered by the New York - Cal. Industrial Corp. for those properties outlined in Exhibit "A" are formally accepted on behalf of the citizens of San Rafael. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of said City held on Monday the fifth day of March 1979, by the following vote, to wit: AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None "(Z� � A.
