RESOLUTION OF THE COUNCIL OF THE CITY OF SAN RAFAEL
DECLARING CANVASS OF RETURNS AND RESULTS OF GENERAL
MUNICIPAL ELECTION HELD ON MARCH 6, 1979
WHEREAS, in pursuance of law and the Charter of the City of San Rafael,
there was held in said City and in San Rafael School District and in San Rafael
High School District on Tuesday, the 6th day of March, 1979, a general municipal
election to elect municipal officers and members of the Board of Education, at
which election the offices to be filled and the candidates for such offices were
as follows:
FOR MAYOR: (One to be elected for a full term of 4 years)

FOR CITY COUNCIL: (Two to be elected for full term of 4 years each)

WHEREAS, at said election the following measures, and each of them, were
submitted to the electors of the City:
MEASURE A - $5,000 MAXIMUM NOT LET BY BID
Shall Sections 3 and 3.1 of Article XIII of the Charter of the
City of San Rafael be amended to provide that the City of San Rafael shall have the
power to award contracts without going to bid for public work to be done by contract
and for the purchase of supplies, materials, machinery and equipment amounting to
$5,000 or less? The text of said amendment is set forth in Section A of Resolution
No. 5589 passed by the City Council of the City of San Rafael on Thursday,
December 21, 1978, and is now on file in the office of the City Clerk.
MEASURE B - LEASING CITY PROPERTY
Shall Section 12 of Article III of the Charter of the City of San
Rafael be amended to provide that leases of San Rafael property for a period of less
than five years, or for total rents that do not exceed $6,000, need not be
accomplished by Ordinance? All other leases must be by Ordinance. The text of
said amendment is set forth in Section B of Resolution No. 5589 passed by the City
Council of the City of San Rafael on Thursday, December 21, 1978, and is now on
file in the office of the City Clerk.
MEASURE C - CITY TAX AND LICENSE COLLECTOR
Shall the Charter of the City of San Rafael be amended effective at
midnight the day prior to the General Municipal Election in 1983, so as to make the
office of City Tax and License Collector appointive rather than elective? The text
of said amendment is set forth in Section C of Resolution No. 5589 passed by the
City Council of the City of San Rafael on Thursday, December 21, 1978, and is now
on file in the office of the City Clerk.
MEASURE D - ESTABLISHMENT OF NEW ELECTION DATE
Shall the Charter of the City of San Rafael be amended to change the
date of the San Rafael General Municipal Election from the Tuesday after the first
Monday in March of each odd -numbered year to the first Tuesday after the first
Monday in November of each odd -numbered year or as hereafter provided by the State
Legislature under the general law provisions determining the date of election for
the governing board members of a school district? The text of said amendment is
set forth in Section D of Resolution No. 5589 passed by the City Council of the
City of San Rafael on Thursday, December 21, 1978, and is now on file in the office
of the City Clerk.

MEASURE E - ESTABLISHMENT uF PARAMEDIC SERVICE
Shall the City Council of the City of San Kafael enact an
ordinance to provide for a Paramedic Service funded by a special assessment of up
to twelve ($12) dollars per year for each living unit, as a basic charge and to be
revised each year if needed, as provided for in Section 3.28.060 of the Ordinance?
Non-residents shall be billed an appropriate amount to reflect the cost of the
service. The text of said ordinance is set forth as an exhibit to Section E of
Resolution No. 5589, passed by the City Council of the City of San Rafael on
Thursday, December 21, 1978, and is now on file in the office of the City Clerk.
WHEREAS, said general municipal election was held on Tuesday, March 6,
1979, in accordance with law and the votes thereat received and canvassed, and the
returns thereof ascertained, determined and declared in all respects as required
by law;

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Rafael,
1. That the City Clerk of the City of San Rafael be, and is hereby,
instructed to enter this resolution on the minutes of the Council as a statement
of the results of said election.

2. That the whole number of votes cast at said election was 10,253
(a) That the total number of votes cast for municipal
offices and measures at said election in said City
was 9,660
(b) That the total number of votes cast outside the
city limits of said City in said School Districts
was 593
3. That the names of the persons voted for and the respective offices
to be filled, for which ballots were cast, and the number of votes given in each
precinct and by absentee voters to each of said persons was as detailed in Exhibit A,
attached.
4. That at said general municipal election the following named persons
received the largest number of votes for the following offices, respectively, and
were, therefore, duly elected to the respective office for which they were respectively
candidates, and each of said persons having received the largest number of votes cast
for any person for such office is hereby declared to be duly and regularly elected to
such office, respectively for the term commencing March 13, 1979, and the City Clerk

is hereby directed to issue a Certificate of Election to each of said persons,
certifying his/her election to the office appearing after his/her name, and to
administer or direct administration to each of said persons the oath of office
prescribed by the Constitution and laws of the State of California and the
Charter of said City, to wit:

5. That more than a majority of all the votes cast on said Measure A
were in favor of said Measure, and said Measure carried.
6. That more than a majority of all the votes cast on said Measure B
were in favor of said Measure, and said Measure carried.
7. That more than a majority of all the votes cast on said Measure C
were in favor of said Measure, and said Measure carried.
8. That more than a majority of all the votes cast on said Measure D
were in favor of said Measure, and said Measure carried.
9. That more than two-thirds of all the votes cast on said Measure E
were in favor of said Measure, and said Measure carried.
10. That all absentee voters' ballots have been duly received and
canvassed in time, form and manner as required by law.

that the foregoing resolution was duly and regularly introduced and adopted at a
regular adjourned meeting of the Council of said City held on Tuesday, the thirteenth
