RESOLUTION OF THE SAN RAFAEL CITY COUNCIL STATING THE
CONCLUSION AND FINDINGS REGARDING APPLICATION s78-29
(FOUR LOT SUBDIVISION ON ELIZABETH WAY)
WHEREAS, the San Rafael City Council on March 19, 1979, held a public
hearing to consider appeals concerning the approval (by the San Rafael Planning
Commission on January 9, 1979) of subdivision request s78-29; and
WHEREAS, the proposed subdivision requested the creation of four lots
for Assessor's Parcel Nos. 10-083-02 and 10-133-15; and
WHEREAS, an initial study was prepared for this project and the
Planning Commission adopted a negative declaration prior to their approval; and
WHEREAS, numerous vicinity residents objected to the Planning Commission
approval of s78-29 because of slides on and near the property, traffic impacts
of the project, and the open space status of the property; and
WHEREAS, the City Council heard and considered presentation by staff,
the project soils engineers, the applicant and neighboring residents; and
WHEREAS, the City Council considered information in the initial study
prepared for the project;
NOW, THEREFORE, BE IT RESOLVED, that the proposal to subdivide
Assessor's Parcel Nos. 10-083-02 and 10-133-15 into four lots be denied because
the project is not consistent with the General Plan in that portions of the
subdivision contain unstable soils, that portions of the project area are
indicated as having major environmental constraints in the land capability of
major undeveloped areas, that the site is not physically suitable for the
proposed density, and that the design of the subdivision or public improvements
are likely to cause substantial environmental damage.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the City Council of said City held on
Monday the second day of April 1979, by the
following vote, to wit:

NOES: COUNC I LMEN : None
