HomeMy WebLinkAboutResolution No. 5671RESOLUTION NO. 5671 RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL TO VACATE A DRAINAGE AND SLOPE EASEMENT ON LOT 31, GLENWOOD FOREST UNIT ONE, SAN RAFAEL, CALIFORNIA WHEREAS, it appears that the easement hereinafter described is unnecessary for present or prospective public use; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael, California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California; 2. That the City Council of the City of San Rafael, California, hereby declares its intention to close, vacate and abandon the easement hereinafter described; 3. That Monday, the 4th day of June, 1979, at 8:00 o'clock P.M., in the Council Chambers at the City Hall in the City of San Rafael, California, is hereby set as the time and place for hearing all persons interested in the proposed closing, abandoning and vacation of said easement; 4. That the Department of Public Works of the City of San Rafael shall post conspicuously notices of easement vacation along the line of the said easement proposed to be closed, abandoned and vacated, which notices shall be posted not more than three hundred (300) feet apart but at least three (3) notices shall be posted as to each such easement proposed to be closed, abandoned and vacated. Said notice shall state the time and place of the hearing, as hereinabove provided, and the adoption of the within resolution of intention; 5. That said easement proposed to be closed, abandoned and vacated is described on Exhibit A which is attached hereto and incor- porated herein by reference; 6. That a map or plan showing said easement proposed to be closed, abandoned and vacated is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City held on the 7th day of May, 1979, by the following vote, to wit: AYES: COUNCILMEN: Brei ner, Jensen, Mi skimen, Nixon and Mayor Mul ryan NOES: COUNCILMEN: None ABSENT: COUNCILMEN: None "NE M. LEONCINI, City Clerk DM EXHIBIT A DESCRIPTION OF DRAINAGE AND SLOPE EASEMENT TO BE VACATED That certain drainage and slope easement occupying a portion of Lot 31 as shown on the Map of "Glenwood Forest Unit One", recorded July 8, 1964 in Volumn 12 of Maps at Page 82, Marin County records. Excepting therefrom, however, a drainage easement 5 feet wide adjacent to the southerly line of said lot 31 running easterly 20.86 feet from the westerly line of said drainage and slope easement.
