HomeMy WebLinkAboutResolution No. 5676RESOLUTION NO. 5676 RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING VACATION OF A PORTION OF REDWOOD HIGHWAY BETWEEN WILLOW AVENUE AND THE SOUTHBOUND OFF -RAMP FROM HIGHWAY 101, SAN RAFAEL, CALIFORNIA WHEREAS, it appears that a portion of Redwood Highway between Willow Avenue and the southbound off -ramp from Highway 101 hereinafter described is unnecessary for present or prospective public purposes, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the City Council of the City of San Rafael hereby elects to proceed under the provisions of the STREET VACATION ACT OF 1941 of the State of California; 2. That the City Council of the City of San Rafael hereby declares its intention to vacate a portion of Redwood Highway between Willow Avenue and the southbound off -ramp from Highway 101 which is hereinafter described; 3. That the 4th day of June, 1979, at 8:00 P.M., in the Council Chambers, City Hall, San Rafael, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to the said proposed vacation. 4. That the Planning Department of the City of San Rafael shall post conspicuously notices of street vacation along the lines of said public street proposed to be vacated, which notices shall be posted not more than three hundred (300) feet apart but at least three (3) notices shall be posted as to said street proposed to be vacated. The said notice shall state time and place of hearing as hereinabove provided, and the adoption of the within Resolution of Intention. 5. That said street proposed to be vacated is described on Exhibit "A", which is attached hereto and incorporated herein by this reference as though set forth in full. 6. That a map or plan showing said street proposed to be vacated is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San Rafael, California. an -51 N AL .4 I, JEANNE M. LEONCINI, Oity Clerk S EXHIBIT "A" Legal Description That certain real property situate in the County of Marin, State of California, described as follows: Being a portion of Tamalpais Avenue, (commonly known as Redwood Highway,) as shown on the map entitled, "Map of Subdivision A of Golf Links Tract", filed for record January 14, 1908 in Volume 2 of Maps at page 107, Marin County Records, more particularly described as follows: BEGINNING at the most Northerly corner of Lot 1 in Block 28, as shown on the aforementioned map, said corner being also on the Northeasterly line of said Block; thence from said corner North 60° 49' 49" East 20.00 feet; thence South 29° 10' 11" East 210.00 feet; thence South 19° 47' 08" East 122.67 feet to a point on the said Northeaterly line; thence along said line North 29° 10' 11" West 331.03 feet to the Point of Beginning.
