HomeMy WebLinkAboutResolution No. 5686RESOLUTION NO. 5686 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING VACATION OF A PORTION OF REDWOOD HIGHWAY BETWEEN WILLOW AVENUE AND THE SOUTHBOUND OFF -RAMP FROM HIGHWAY 101, SAN RAFAEL, CALIFORNIA WHEREAS, the City Council of the City of San Rafael, on the 7th day of May, 1979, passed and adopted Resolution No. 5676, entitled, "RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING VACATION OF A PORTION OF REDWOOD HIGHWAY BETWEEN WILLOW AVENUE AND THE SOUTHBOUND OFF -RAMP FROM HIGHWAY 101, SAN RAFAEL, CALIFORNIA," and WHEREAS, notice was published and posted as required by law, and WHEREAS, a hearing was had this day as required by law, and said Resolution No. 5676, at which hearing the Council of the City of San Rafael heard evidence offered by all persons interested in or objecting to the vacation hereinafter ordered, and WHEREAS, it appears from the evidence offered and from all of the evidence submitted, and the said Council finds, that the portion of the street herein described is unnecessary for present or prospective public street purposes, NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that PORTION OF REDWOOD HIGHWAY BETWEEN WILLOW AVENUE AND THE SOUTHBOUND OFF -RAMP FROM HIGHWAY 101, located in the City of San Rafael, California, hereinafter more particularly described, is unnecessary for present or prospective public street purposes and is hereby vacated subject to the recordation of a perpetual covenant restricting the use of this area to landscaping only. The public street proposed to be vacated is located in the City of San Rafael, State of California, designated as a portion of Redwood Highway between Willow Avenue and the southbound off -ramp from Highway 101, and is more particularly described as follows: Being a portion of Tamalpais Avenue, (commonly known as Redwood Highway,) as shown on the map entitled, "Map of Subdivision A of Golf Links Tract", filed for record January 14, 1908 in Volume 2 of Maps at page 107, Marin County Records, more particularly described as follows: BEGINNING at the most Northerly corner of Lot 1 in Block 28, as shown on the aforementioned map, said corner being also on the Northeasterly line of said Block; thence from said corner North 600 49' 49" East 20.00 feet; thence South 29° 10' 11" East 210.00 feet; thence South 190 47' 08" East 122.67 feet to a point on the said Northeasterly line; thence along said line North 290 10' 11" West 331.03 feet to the Point of Beginning. RESERVING, however, to Pacific Gas and Electric Company the right from time to time to install, maintain, repair, operate, replace, remove and renew lines of pipes, wires, poles and other structures, equipment and fixtures, both above ground and under ground, for the operation of said facilities in said Tamalpais Avenue. -2- ' 1�I AL I, JEANNE M.
