HomeMy WebLinkAboutResolution No. 5706RESOLUTION NO. 5706 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael a contract, lease or agreement with San Rafael High School District Re: San Rafael High School Swimming Pool. a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted ata regular meeting of the City Council of said City held on Monday the 18th day of June , 19 79 by the following vote, to wit: AYES: COUNCILMEMBERS: Jensen, Miskimen and Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Breiner and Nixon J &�EM.LEONCINI, City Clerk ORIu�,�i[1N1AL MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding, made and entered into this 1st day of June, 1979, by and between the City of San Rafael, here- inafter referred to as "City" and the San Rafael School District, hereinafter referred to as "District". • DL`07MAT Q WHEREAS, City and District are mutually agreeable to a contractural agreement allowing City to use the Swimming Pool at San Rafael High School. WITNESSETH For and in consideration of mutual promises, covenants and conditions hereinafter contained, the parties hereto agree as follows: 1. City is hereby granted by District, the exclusive right to use the San Rafael High School Swimming Pool and Locker Rooms for City recreational purposes from June 16, 1979 to August 19, 1979. 2. City agrees to reimburse District for the personnel cost of maintaining the Pool for the period of use in the amount of $1,051.00. 3. City agrees to reimburse District for the cost of utilities and chemicals necessary to maintain Pool for the period of use in the amount of $ 700.00 4. City agrees to take full responsibility in cleaning and maintaining the male and female locker rooms. 5. City agrees to accept the responsibility of opening and closing Gymnasium and Swimming Pool. Page One. MEMO OF UNDERSTANDING - Continued 6. The City is responsible for notifying the District of any mechanical malfunction of Pool equipment immediately. The District is responsible for making the repairs on the Pool equipment and may close the Pool for a period of time while repairs are made. All charges will be paid onsa pro -rata basis if the Pool is closed by the District for repair. 7. City shall indemnify and hold District harmless from any liability for personal injury or property damage arising out of the use of District facilities by City pursuant to this Agreement.
