A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of the
City of San Rafael a contract, lease or agreement with
COUNTY OF MARIN AND SAN RAFAEL SCHOOL DISTRICT RE:
ESTABLISHING A SAILING CENTER AT McNEAR BEACH PARK.
a copy of which is hereby attached and by this reference made a part hereof.

JOINT POWERS AGREEMENT
THIS AGREEMENT, made and entered into this Z $$ tt_ day
of 1979, by and between the COUNTY OF MARIN, hereinafter
referred to as "COUNTY", the CITY OF SAN RAFAEL, hereinafter
referred to as "City", and the SAN RAFAEL HIGH SCHOOL DISTRICT,
IiEREINAFTER referred to as "District"
WHEREAS, Chapter 5, Division 7, Title -I of the California
Government Code provides for Joint Powers Agreements between public
bodies; and
WHEREAS, it is in the mutual interest of the parties hereto to
establish a small boating center at McNear's Beach Park to be the
headquarters for boating programs sponsored by the District and City;
said site will hereinafter be referred to as "Boating Center". Limits
of said Boating Center are depicted in Exhibit "A", attached hereto
and incorporated herein by reference.
NOW, THEREFORE, in consideration of the mutual promises and
covenants hereinafter contained, the parties do hereby agree as
follows:
COUNTY AGREES TO:
1. Make the Boating Center available to City and District for
boating programs, including parking and facility use during
hours and days approved by County at no charge to City or
District.
2. Install utilities to the indoor facilities and pay for
monthly utility costs. (water and electricity.)
DISTRICT AGREES TO:
1. Provide Boating Center, including necessary boats and
equipment.
2. Provide general clean-up to the Boating Center, including
making necessary repairs to building, bringing the building
up to safe standards, t�ermined by County.
3. Reimburse County for o- utility installation cost'.
Provide ditch for water hook-up and electric box for service
to existing building.
CITY AGREES TO:
1. Provide boating program, including necessary boats and

CITY AND DISTRICT AGREE TO:
1. Keep the Boating Center clean of litter in and about the
grounds in use.
2. Maintain boating equipment in a good state of repair.
3. Exercise approved U.S. Coast Guard and Red Cross boating safety
rules and regulations at all times.
4.
Provide motor powered rescue boat in good working order, on the
site during all boating classes held on the
water.
5.
Provide qualified supervision at the Boating
Center during all
programs.
6.
City and District hereby indemnify, default,
and hold the County,
its officers, agents, servants and employees,
while acting as
such, free and harmless from any liability
from any obligation
arising by virtue of law, because of injury
to property or injury
or death of persons received or suffered by
reason of any City
or District activities or use of the Boating
Center pursuant to
this agreement.
7.
Any additions, deletions to the Sailing Center
must be agreed
upon by all three parties.
TERMINATION:
This Agreement may be terminated at any time by either party
upon giving the other parties hereto at least 9 mon.ths,writ.t:en notice.
If either the City or the District terminates their interest in this
agreement the remaining party can elect to continue the terms of
the agreement with the County.
IN WITNESS WHEREOF, the parties hereto have executed this
Joint Powers Agreement the day and year first above written.
