RESOLUTION OF INTENTION TO ORDER
VACATION OF PUBLIC STREET
(Portion of Bay Way)
WHEREAS, it appears that the easterly terminus of Bay Way
hereinafter described is unnecessary for present or prospective public
purposes,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City Council of the City of San Rafael hereby
elects to proceed under the provisions of the STREET VACATION ACT OF
1941 of the State of California;
2. That the City Council of the City of San Rafael hereby
declares its intention to vacate the easterly terminus of Bay Way
which is hereinafter described;
3. That the 6th day of August, 1979, at 8:00 P.M., in the
Council Chambers, City Hall, San Rafael, California, is hereby fixed
as the time and place for hearing all persons interested in or object-
ing to the said proposed vacation.
4. That the Department of Public Works of the City of San
Rafael shall post conspicuously notices of street vacation along the
lines of said portion of public street proposed to be vacated, which notices
shall be posted not more than three hundred (300) feet apart but at
least three (3) notices shall be posted as to said portion of street
proposed to be vacated. The said notice shall state time and place of
hearing as hereinabove provided, and the adoption of the within Resolu-
tion of Intention.
5. That said portion of street proposed to be vacated is
described on Exhibit "A", which is attached hereto and incorporated
herein by this reference as though set forth in full.
6. That a map or plan showing said portion of street pro-
posed to be vacated is on file in the office of the City Clerk of the
City of San Rafael at the City Hall, San Rafael, California.

hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City held on the 2nd day of July, 1979, by the following vote, to wit:

DESCRIPTION
All that certain real property situate in the City of San Rafael, County
of Marin, State of California, described as follows: .
BEGINNING st a point on the Northerly line of Lot 60 in Block 6, as
shown upon that certain Map entitled, "Map of Uplands", filed November
20, 1908 in Book 3 of Maps at Page 4, Marin County Records, distant thereon
North 85° 24' East 48.69 feet from the Northwestel-ly corner thereof;
thence due North 50 feet to a point in the Southerly line of Lot 65 in
Block 7, Map above referred to; thence along said Southerly line North
85° 24' East to the Southeast corner thereof; thence South 63° 05' East
109.116 'feet; thence running around the arc of a ciruclar turn, whose
center bears South 29° 34' East and whose radius is 40 feet, distant
197.43 feet; thence North 630 05' West 97.335 feet and South 850 24'
West 106.66 feet to the point of beginning.
RESERVING, however, an easement for public utilities over the entire area
described above.
