A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
GRANTING A LANDSCAPE/SCENIC EASEMENT OF A PORTION OF
AP 16-161-34 TO LAWRENCE T. ODEN
WHEREAS, Lawrence T. Oden has requested the right for a
landscape/scenic easement into City -owned property; and
WHEREAS, The City Council has reviewed this request and
determined that Mr. Oden's request has validity in that the existing
conditions were caused by a misalignment of lot lines at some
earlier date;
NOW, THEREFORE, BE IT RESOLVED by the San Rafael City
Council that a landscape/scenic easement is granted to Lawrence T.
Oden for a portion of AP 16-161-34;
BE IT FURTHER RESOLVED that the landscape/scenic easement
is for the area which includes the fence, sprinkler system and three
mature trees on AP 16-161-34 as generally described on Attachment "A"
and on Attachment "B", the Grant of Easement;
BE IT FURTHER RESOLVED that the responsibility for the
determination of the pertinent engineering data preparation of the
Grant of Easement and recordation of same are the responsibility of
Lawrence T. Oden,
BE IT FURTHER RESOLVED that prior to the recordation of
this matter, the City Engineer shall approve the specific area of
the easement in question.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council of
said City held on Monday the second day of July 1979,
by the following vote, to wit:

the' real property in the City of San Rafael
County of Marin State of California, described as
A LANDSCAPE, SCENIC EASEMENT, .r6 feet wide, lying Easterly of and contiguous to the
following described line:
BEGINNING at a point on the Southerly line of Balboa Avenue (formerly Portola Ave.),
said point being the most Northeasterly corner of Lot 52, as shown upon that certain
map entitled, "Map of Villa Real, Unit One, San Rafael, California", filed for record
June 2, 1955 in Volume 8 of Maps, at Page 66, Marin County Records; running thence from
said point of beginning and along the Easterly line of said Lot 52, South 19e 00' East
116.951 feet; thence leaving said line and running South 22° 56' 55" East 12.357 feet
to the point of termination.
SAID EASEMENT to run for its' full width from Balboa Avenue to the point of termination
and is appurtenant to the lands of the grantee described in the Deed recorded March 2, 1979
in Book 3509 of Official Records, at Page 233, Marin County Records.
