A RESOLUTION OF THE CITY COUNCIL RESCINDING
THOSE PORTIONS OF RESOLUTIONS 5739 AND 5740,
APPLICABLE TO CERTAIN WITHIN NAMED JOB DESCRIPTIONS
WHEREAS, the City has previously and on August 6,
1979, adopted Resolution No. 5739, designating Secretary (City
Attorney) and Accountant (Finance) as "Confidential Employees"
pursuant to Section 3507.5 of the Government Code of the State
of California; and
WHEREAS, the City has previously and on August 6,
1979, adopted Resolution No. 5740, creating and implementing
new salary ranges and benefits for said Secretary (City Attorney)
and Accountant (Finance) job descriptions; and
WHEREAS, the Marin County Superior Court has, by and
through its Order of September 14, 1979, enjoined the City from
implementing said Resolutions 5739 and 5740 as to the positions
of Secretary (City Attorney) and Accountant (Finance) only; and
WHEREAS, City desires and intends to comply with said
lawful and regularly issued Order of Court;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of San Rafael that the following listed job descriptions
and the employees occupying said job descriptions be removed from
the listing of Confidential Employees set forth in Resolution No.
5739, and be removed from the classification and salary range
schedule and benefit descriptions set forth in Resolution No.
5740; Resolutions 5739 and 5740 are rescinded effective September
15, 1979, as they apply to the positions of Secretary (City
Attorney) and Accountant (Finance), in compliance with the Order
of Marin County Superior Court, Action No. 94886, dated September
14, 1979 (copy attached and by this reference incorporated herein).

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing Resolution was duly and regu-
larly introduced and adopted at a special meeting of the Council
of said City on Thursday, the 20th day of September, 1979, by
the following vote, to wit:
