A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL DESIGNATING CONFIDENTIAL EMPLOYEES
WHEREAS, the City has previously adopted Resolution
No. 5739 designating certain thereon listed job descriptions,
and the employees occupying said jobs, as "Confidential Em-
ployees", pursuant to Section 3507.5 of the Government Code
of the State of California; and
WHEREAS, Resolution No. 5739 listed the job descriptions
and employees, Secretary (City Attorney) and Accountant (Finance)
among those designated as "Confidential Employees"; and
WHEREAS, Marin Association of Public Employees (MAPE)
has sued the City in Marin County Superior Court, requesting an in-
junction against City, preventing designation of those employees
listed in Resolution No. 5739 as "Confidential", and further seek-
ing to prevent payment of new compensation to said listed employees
as set forth in Resolution 5740 until after consultation in good
faith; and
WHEREAS, on September 14, 1979, the Marin County Superior
Court issued an Order granting a preliminary injunction against
the City as to application of Resolutions No. 5739 and 5740 to
the positions of Secretary (City Attorney) and Accountant (Finance
Department) only; and
WHEREAS, MAPE has, in Court and in conversation with City
representatives, stated there exists no question or contest as to
the confidential nature of said Secretary (City Attorney) and/or
Accountant (Finance Department), and further, since the date of
the Court's Order on September 14, 1979, City has discharged its
obligation to consult with MAPE in good faith; and

RESOLUTION NO. 5771
WHEREAS, further pursuant to the Court's Order of
September 14, 1979, City has rescinded those portions of Resolu-
tion No. 5739 and 5740 relating to Secretary (City Attorney) and
Accountant (Finance);
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of San Rafael that the following listed employees shall
be designated as "Confidential Employees", pursuant to Section
3507.5 of the Government Code of the State of California:
Secretary (City Attorney)
Accountant (Finance).
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing Resolution was duly and regu-
larly introduced and adopted at a special meeting of the Council
of said City on Thursday, the 20th day of September, 1979, by
the following vote, to wit:
AYES: COUNCILMEMBERS: Breiner, Jensen, Miskimen, Nixon &
Mayor Mulryan
