WHEREAS, pursuant to Streets and Highways Code 536500 et seq., the Council of the City of San Rafael may create a parking and business improvement area for the general promotion of retail trade activities in an area; and WHEREAS, certain merchants within the downtown San Rafael business area have approached the City Council and have requested Council consideration of such a parking and business improvement area; and WHEREAS, pursuant to Streets and Highways Code 536521 the City Council is required to adopt a Resolution of Intention to establish an area; and WHEREAS, said Resolution of Intention shall contain specified inf ormation; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that: 1. The City Council does hereby adopt a Resolution of Intention to establish a parking and business improvement area within the downtown San Rafael area; follows: 2. The boundaries of the area encompassed are described as Bounded on the North by Fifth Avenue from "H" Street to "C" Street, and generally by frontage properties on the North side of Fifth Avenue from "C" Street to Lincoln Avenue; Bounded on the East by Lincoln Avenue from Fifth Avenue to Ritter Street; Bounded on the South side by Ritter Street, Lindaro Street, and generally by Second Street to "E" Street, and by frontage properties on the West side of "E" Street and by frontage properties on the South side of Fourth Street to a point opposite El Camino Avenue; Bounded on the West by the last included property and by "H" Street to Fifth Avenue, as shown in Graphic Exhibit "A" attached hereto and incorporated herein; 3. A Public Hearing shall be heard before the City Council on November 5, 1979 at 8:00 P.M. in the Council Chambers of San Rafael City Hall, or as soon thereafter as may be heard, to consider establishment of said parking and business improvement area; �RY6"INAL r°' RESOLUTION NO. 5782 4. The proposed uses for the revenues derived from said parking and business improvement area shall be used for the following purposes: a. Pay for free parking at parking meters within the business improvement area; b. Decoration of any public place in the area; C. Promotion of public events which are to take place on or in public places in the area; d. Furnish music in any public place in the area; e. The general promotion of trade activities in the area. 5. A charge system will be levied whereby each business entity within the business improvement area shall pay an amount equal to 50% of the business license tax for each business within said area as set forth in the current City of San Rafael Business License Fee Schedule, and as amended. (Exhibit "B" attached hereto and incorporated herein.) Those businesses within the boundaries of the District who are exempt from the payment of a business license under State law shall not be assessed. Also excluded from the assessment shall be apartments, boarding/rooming houses, mobile home parks, hospitals, convalescent homes, nursing homes, rest homes or sanitariums, and ambulance services. This Resolution of Intention shall be published at least once in a newspaper of general circulation within the City of San Rafael, and a complete copy of said Resolution shall be mailed to each business in the proposed area. Said publication and mailing shall be completed at least ten days prior to the time of the hearing set for November 5, 1979. I, JEANNE M.
