RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESCINDING RESOLUTION NO. 4711 (REQUIRING ANY CONTRACTOR
BIDDING ON CITY WORK TO HAVE CITY BUSINESS LICENSE
AT TIME OF MAKING BID)
WHEREAS, The City of San Rafael is involved in many public works
and other projects requiring public bidding; and
WHEREAS, contractors from other areas bid for and on such projects
and contracts; and
WHEREAS, it has been the policy of the City to require that prior
to the submittal of a bid by any contractor for a public project or contract
undertaken by the City of San Rafael, said contractor have a valid and
subsisting City of San Rafael business license; and
WHEREAS, a survey of other jurisdictions in the County has shown
that San Rafael is the only agency with such a requirement and a survey of
private contractors has shown that this requirement does affect their
willingness to bid on projects, particularly the smaller projects; and
WHEREAS, this past policy creates a possible deterrent to the
City's receiving bids from out-of-town contractors, therefore, reducing the
City's choice of potential low bidding contractors.
NOW, THEREFORE, BE IT RESOLVED that contractors submitting a bid
for contracts or projects to be performed for the City of San Rafael not be
required to have a valid and subsisting City of San Rafael business license
at the time of the submittal of said bid.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the City Council of said City held on
Monday the fifth day of November , 19'79 by
the following vote, to wit:

NOES: COUNCILMEMBERS: Non e
