A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The f-1AYOR and CITY CLERK are authorized to execute, on behalf of the
City of San Rafael a contract, lease or agreement with
Dixie School District for building use at Don Timoteo School
Room 15 and a boys' and girls' lavatory, for the purpose of
conducting a child care program.
a copy of which is hereby attached and by this reference made a part hereof.

DIXIE SCHOOL DISTRICT
Agreement
This agreement shall be between the City of San Rafael Recreation
Department and the Dixie School District for the building use at
Don Timoteo School, Room 15 and a boys' and girls' lavatory,.for
the purpose of conducting a child care program as follows: *
A. The District aqrees to:
1. Allow the City of San Rafael Recreation Department access
to and unrestricted use of Room 15 and use of a boys' and
girls' lavatory.
2. The District agrees to maintain the facilities except that
no custodial services shall be provided.
B. The City agrees to:
1. Operate the program in a .manner that creates the least
possible disturbance to the ongoing educational program at
Don Timoteo School.
2. Restrict parking for purposes of the Child Care Program to
areas not required by personnel and parents of children
attending Don Timoteo School.
3. Provide adequate custodial coverage to keep the room clean
and in order.
4. Restrict use of outdoor equipment and play equipment during
times when the children at Don Timoteo School are utilizing
this equipment.
5. Be responsible to communicate adequately to the parents and
personnel involved in the program, the conditions outlined
in this agreement.
6. Provide public liability insurance coverage in the amount of
$300,000 per person, $1,000,000 per accident, property damage
of $300,000 and fire legal liability of $30,000 naming
District as additional insured. Proof of such coverage
shall be forwarded to the District within 10 working days of
ratification of this agreement by the City.
7. Upon termination of this agreement City shall return the
premises to District in the original condition, normal wear
and tear excepted.

8. Provide adequate adult supervision over the conduct of all
activities on the premises.
9. Pay the sum of $126 per month for the use of Room 15.
10. Pay the sum of $14 per month for use of the boys' and girls'
lavatories as herein noted.
11. The agreed upon amount shall be paid on or before June 30, 1980.
It is further agreed:.
C. That the Parks and Recreation Department of said City, hereby holds
the District, its officers, agents, servants and employees, while
acting as such, free and harmless from any liability from any
obligations arising by virtue of law, because of injury to property
or injury or death of persons received or suffered by reason of any
action of the City under the provisions of this agreement.
D. That the District hereby hold the City, its officers, agents,
servants and employees, while acting as such, free and harmless from
any liability from any obligations arising by virtue of law, because
of injury to property or injury or death of persons received or
suffered by reason of any action of the District under the provisions
of this agreement.
E. This agreement may be amended or terminated by the mutual consent of
the parties hereto and may be cancelled by either party upon thirty
(30) days written notice delivered by hand to the chief executive
officer of the other party.
