RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING EXECUTION BY THE MAYOR AND CITY CLERK OF THE
AMEND14ENT TO THE CALIFORNIA DEPARTMENT OF NAVIGATION AND
OCEAN DEVELOPMENT LOAN AGREEMENT
WHEREAS, the City of San Rafael has previously executed
an Agreement with the California Department of Navigation and Ocean
Development for a planning loan; and
WHEREAS, said previous Agreement recited that repayment
of the $35,000 planning loan would commence August 1, 1977; and
WHEREAS, the parties now mutually agree to amend repay-
ment of the loan in accordance with the terms and provisions set
forth in the Amendment to the Agreement, attached and incorporated
herein as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF SAN RAFAEL that the Mayor and City Clerk of San Rafael be and
hereby are authorized on behalf of the City to execute the Amendment
to Agreement between the City of San Rafael and the California De-
partment of Navigation and Ocean Development, attached herein as
Exhibit "A".
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing Resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City held on Monday the sixth day of February , 1978,
by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon

2. It is intended that repayment of the loan should be made in
accordance with the attached repayment schedule.
III.
GENERr1L TERMS
The DEPARTMENT and the APPLICANT agree as follows:
1. That so much of paragraph 8(a) of PREVIOUS AGREEMENT as reads
"August 1, 1976" be deleted and the following substituted therefor:
"August 1, 1977".
2. Save and except as herein amended, the PREVIOUS AGREEMENT sh`ll
remain in full force and effect.
