A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING EXECUTION OF AGREEMENT WITH
DEVELOPER, SHANNON SUBDIVISION, SAN RAFAEL, CALIF.
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES
as follows:
The Mayor and City Clerk are authorized to execute, on
behalf of the City of San Rafael, an Agreement with RAYMOND J.
FINEGAN, MARY JEAN FINEGAN, HAROLD GOODMAN, RUBY GOODMAN,
14ARTIN SHIMAN and KAY SHIMAN, a copy of which is attached hereto,
marked Exhibit "A", and incorporated herein by this reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 6th day of February, 1978, by
the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan and Mayor Bettini
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Nixon

A G R E E M E N T
THIS AGREEMENT is entered into on the 6th day of February,
1978, by and between the CITY OF SAN RAFAEL, hereinafter referred to
as "City", and RAYMOND J. FINEGAN, MARY JEAN FINEGAN, HAROLD GOODMAN,
RUBY GOODMAN, MARTIN SHIMAN, and KAY SHIMAN, hereinafter collectively
referred to as "Developer", for the purpose of reimbursing Developer
for roadway improvement construction costs.

WHEREAS, RAYMOND J. FINEGAN, et al, received approval from
City for the Shannon Subdivision in San Rafael, on file in the Office
of the County Recorder of the County of Marin in Book 16 of Record
Maps at page 88, consisting of seven (7) separate lots, and according-
ly constructed Shannon Lane to serve said lots; and
WHEREAS, Developer has requested that Lot 7 of the Shannon
Subdivision be further subdivided into four (4) separate single family
lots; and
WHEREAS, Developer has agreed to dedicate to City an area of
Lots No. 5 and No. 7 in Shannon Subdivision up to the property line
of, and to provide access to, the westerly adjacent Angiolini property
(Assessor's Parcel No. 177-240-06); and
WHEREAS, both parties agree that future development of adjacent
property east of Shannon Subdivision which will utilize Shannon Lane
for access should be assessed an equitable prorata amount for the cost
of constructing the Shannon Lane improvements; and
WHEREAS, said contribution amounts to the sum of $ C CCC
NOW, THEREFORE, IT IS HEREBY AGREED AS FOLLOWS:
That if City allows any further use of Shannon Lane for access
to existing undeveloped lands to the east of Shannon Lane known as
the Duca Property, City will require, as a condition of such subdivi-
sion approval, that, prior to any use of Shannon Lane for said east-
erly adjacent property development, funds in the amount of $ '�[jr (0C.
will be paid to RAYMOND J. FINEGAN, MARY JEAN FINEGAN, HAROLD GOODMAN,

RUBY GOODMAN, MARTIN SHIMAN, and KAY SHIMAN by the owner(s) of
said easterly adjacent property to reimburse them for one-half (1/2)
of the actual improvement cost of Shannon Lane from Fifth Avenue to
a point some 311± feet to the north. Said funds shall be collected
and disbursed prior to approval of a subdivision map for said east-
erly adjacent property.
IN WITNESS WHEREOF, the parties have hereunto set their hands
the day and year first above written.
